<br />1. <br /> <br />o <br /> <br />8 <br /> <br />Personnel Overview Committee--May 19, 2008 1 <br /> <br />PERSONNEL OVERVIEW COMMITTEE <br />MAY 19, 2008-1 :00 PM <br /> <br />MEETING TO ORDER <br />A meeting of the Personnel Overview Committee was called to order by Commission <br />Chairman Ken Pawluk, at 1 :00 PM in the Commission Room, Cass County Courthouse. <br />The following members were present: Scott Wagner, Vern Bennett, Ken Pawluk, Bonnie <br />Johnson, Keith Berndt, Tracy Peters for Birch Burdick, Paul Laney, Mike Montplaisir, Kathy <br />Hogan, Carrie Smith, Toni Hill and Tom Soucy. Darrell Vanyo arrived later in the meeting. <br />The following members were absent: Robyn Sorum and Jim Brent. <br /> <br />POLICY SECTION 2.80 WEAPON POLICY, Amended <br />Mrs. Johnson discussed an amendment to Section 2.80 that will provide the definition of a <br />weapon for policy purposes. She said the change was reviewed by the security committee <br />and the definition was taken from state law. <br /> <br />Mr. Bennett questioned the inclusion of knives with a blade of five (5) inches or more. Mrs. <br />Johnson said this portion was taken directly from state law. Mr. Laney said the five inch <br />blade is well established and enforced statewide. Mr. Laney believes the amendment is <br />appropriate as drafted by the county administrator. <br /> <br />Mr. Montplaisir asked why pepper spray is not included in the definition. Mr. Laney said <br />pepper spray is legal to carry for self-defense. <br />MOTION, passed <br />Mr. Berndt moved and Mr. Laney seconded to adopt Policy Section 2.80 <br />Weapon Policy as amended. On roll call vote, the motion carried <br />unanimously. <br /> <br />Mrs. Johnson said the policy will be posted and will then be formally approved by the county <br />commission at a future meeting. <br /> <br />POLICY SECTION 7.41 SALARY PAY FOR EXEMPT EMPLOYEES, Approved <br />Mrs. Johnson attended an employment law seminar through Dorsey Whitney last year and <br />received a policy on salary pay for exempt employees, which the county already practices <br />under the Fair Labor Standards Act. Mrs. Johnson said Sarah Herman, a local attorney, <br />drafted the policy. <br /> <br />There was some discussion on how to document medical leave for exempt employees. Mrs. <br />Johnson said if the leave involves 4 hours or less, exempt employees are not required to <br />record the time. However, Cass County policy sets the work week and there is the <br />expectation of all employees, exempt and non-exempt, to work 40 hours per week. <br /> <br />Mrs. Hogan suggested the policy be reviewed at the next department head meeting before a <br />final decision is made. Mr. Wagner said the policy is not optional and is required by federal <br />law, which the county is obligated to follow. Mr. Wagner and Mr. Pawluk suggested <br />department heads be educated on the policy in order to implement it within their offices. <br />MOTION, passed <br />Mr. Wagner moved and Mr. Laney seconded to amend the county policy <br />manual to include Section 7.41 Salary Pay for Exempt Employees. <br />Discussion: Mrs. Johnson previously emailed State's Attorney Birch <br />
