<br />Commission Minutes-April 21, 2008 3350 <br /> <br />NOW, THEREFORE, I, Ken Pawluk, by virtue of the authority vested in me as <br />Chairman of the Board of Cass County Commissioners do hereby proclaim Mayas <br />FOSTER CARE MONTH in Cass County and urge all citizens to come forward and <br />do something positive that will help change a lifetime for children and youth in foster <br />care. <br /> <br />b. Amend Commission Policy Manual Section 4.00, Advisory Boards, and <br />appoint Tom Moores to fill an unexpired term on the Cass County Weed <br />Control Board as the West Fargo representative. <br />c. Receive monthly financial statement from the Auditor's Office for the month <br />ended March 31, 2008. <br />d. Receive and file Lost Instrument Bond for Patrick B. Kenney and authorize <br />the county auditor and county treasurer to issue a duplicate check. <br />e. Approve permit for fireworks display to be held at 9:00 PM on May 3, 2008, <br />at Starr Fireworks, 10908 38th Street South in Horace, North Dakota. <br />f. Contract approval <br />- AT & T -tower site lease amendment to existing lease for an AT&T <br />tower in Casselton, North Dakota; <br />Mark Sand & Gravel Dakota Company-Class 13 gravel supply; <br /> <br />Rural cities, subdivisions and organizations-2008 vector control contracts. <br />g. Appoint Lt. Colonel Glenn Ellingsberg from the Sheriff's Office as designee <br />to provide information requested now and in the future throughout the grant <br />application process for the State Criminal Alien Assistance Program <br />(SCAAP), including any request for payments on behalf of Cass County. <br /> <br />6. RESOLUTION #2008-9, MIDA Bond public hearinalapproval for Bethanv on 42nd LLC <br />Proiect <br />Attorney Jon Arntson was present to discuss the MIDA Bond application for the Bethany on <br />42nd Project for an amount not to exceed $25,000,000 for the purpose of financing the <br />construction and equipping a new senior citizen campus at 2955 42nd Street South in Fargo. <br />The project consists of 78 skilled nursing beds and 40 assisted living units. A public hearing <br />is scheduled for today and notice of the hearing was published twice according to state law. <br />Mr. Arntson said the bonds will not be bank qualified due to the volume of bonds already <br />issued by the county this year and are payable solely from the revenues raised from the <br />project that are pledged to repayment of bonds. Shawn Stuhaug, Executive Director of <br />Bethany, was also present. <br /> <br />Mr. Pawluk asked about the interest rate and Mr. Arntson said it will range from 5% to 6%. <br /> <br />The chairman opened the public hearing for comments and hearing none, closed the public <br />hearing. <br />MOTION, passed <br />Mr. Bennett moved and Mr. Wagner seconded to adopt Resolution #2008- <br />9, Approving the Issuance of Housing and Healthcare Facilities Revenue <br />Bonds (Bethany on 42nd LLC Project). Discussion: State's Attorney Birch <br />Burdick has reviewed the documents and it appears provisions are <br />included stating the bonds are not a county liability. He asked Mr. <br />Arntson if he is aware of any other provisions within this agreement that <br />would dispute this issue. Mr. Arntson said he was not aware of any other <br />provisions. On roll call vote, the motion carried unanimously. <br />
