SECTION 1.2. EXHIBITS. The following Exhibits are attached to and by reference made a part of this Indenture: Legal Description of the Real Property; and Exhibit A: Exhibit B: Form of Bond. SECTION 1.3. RULES OF INTERPRETATION. (a) This Indenture shall be interpreted in accordance with and governed by the laws of the State of North Dakota. (b) The words "herein" and "hereof' and "hereunder" and words of similar import, without reference to any particular section or subdivision, refer to this Indenture as a whole rather than to any particular section or subdivision of this Indenture. (c) References in this Indenture to any particular article, section or subdivision hereof are to the designated article, section or subdivision of this Indenture as originally executed. (d) All accounting terms not otherwise defined herein have the meanings assigned to them in accordance with generally accepted accounting principles; and all computations provide for herein shall be made in accordance with generally accepted accounting principles consistently applied and applied on the same basis as in prior years. (e) The Table of Contents and titles of articles and sections herein are for convenience only and are not a part of this Indenture. (j) Unless the context hereof clearly requires otherwise, the singular shall include the plural and vice versa and the masculine shall include the feminine and vice versa. (g) Articles, sections, subsections and clauses mentioned by number only are those so numbered which are contained in this Indenture. (h) For the purposes of this Indenture and the Loan Agreement, a petition in bankruptcy shall be deemed dismissed only if the petition is dismissed by order of a court of competent jurisdiction and no further appeal rights exist from such order and an opinion of independent Counsel is filed with the Trustee stating that such a dismissal has occurred.
