<br />~ <br /> <br />. ~) <br /> <br />CHAPTER 11.:.27 <br />TRANSFER OF COUNTY PROPERTY <br /> <br />) <br /> <br />11-27-o1..Board of county commissioners authorized to sell property - Private and <br />public sale. The board of county commissioners of any county may dispose of any property, <br />either real or personal, which the county has acquired through purchase, forfeiture, or operation <br />of law other than through tax sale proceedings, under this chapter. When the property to be <br />disposed of is estimated by the board to be of a value of less than one thousand dollars, it may <br />be sold at private sale upon the proper resolution of the board. In all other cases, the property <br />may be sold only at public sale or as provided under section 11-27-03.1. <br /> <br />11-27-02; Notice of sale when property sold at public sale. Upon the resolution of <br />the board of county commissioners authorizing the sale of county property at public sale, the <br />county auditor shall cause to be published in the official county newspaper once each week for <br />three consecutive weeks a notice containing a description of the property to be sold and <br />designating the place where and the day and hour when the sale willoe held. The notice .shall <br />specify whether the bids are to be received at auction or as sealed bids as determined by the <br />board. <br /> <br /> <br />11-27'.03.0. Where sale held - Sale to highest bidder. The sale of county property at <br />public sale shall be held at the office of the county auditor and shall be conducted by the auditor. <br />he ro e advertised shall be sold to the hi hest bidder if the hi hest bid is deemed sufficient <br />by a majority of t e mem ers of the oa 0 county commissioners. <br /> <br />1 -27-03.1. Transfer of rea prope y nonexclusive listing agreements. /is an <br />alternative to public sale under section 11-27-01, the board of county commissioners may by <br />resolution describe the real property of the county which is to be sold; provide a maximum rate of <br />fee, compensation, or commission; and provide that the county reserves the right to reject any <br />and all offers determined to be insufficient. After adoption of the resolution, the board of county <br />commissioners may engage licensed real estate brokers to attempt to sell the described property <br />by way of nonexclusive listing agreements. <br /> <br /> <br />11-27-04. Reservation of mineral rights. Repealed by S.L. 1951, ch. 112, S 1. <br /> <br />11-27-04.1. County lands may be conveyed to United States free of reservations. <br />Whenever the United States of America or any of its agencies or agents shall desire or be <br />required to acquire or approve title to lands owned by any county, the board of county <br />commissioners shall have power to convey the same free from any reservation of oil, gas, and <br />minerals and rights thereto, and free of reservations of archaeological materials. <br /> <br />11-27-04.2. Reservations may be released to United States. Whenever any county <br />shall have conveyed lands to any person arid shall have reserved oil, gas, or minerals or rights <br />. therein or archaeological materials and the .United States of America or any of its agencies or <br />agents shall desire or be required to acquire or approve title to such iands, the board of county <br />commissioners shall be authorized to release to the United States of America or its agency or <br />agent everything so reserved. Such board of county commissioners shall have full power to fIX <br />and determine the consideration, if any, and terms upon which such release shall be given and <br />any moneys or other consideration received for such release shall be covered into the fund for <br />the benefit of which such reservations were made. <br /> <br />11-27-05. Drilling or mining leases by county. The county, acting by and through the <br />board of county commissioners, may join with the other owner or .owners of the mineral rights in <br />any lands in wh ich an interest in such rights has been reserved by the county in making any <br />standard or reasonable contract for the drilling, mining, or production of oil, gas, and minerals <br />upon a royalty basis. . <br /> <br />11-27-06. When interest of county in lands conveyed. All the interest of a county in <br />its lands is conveyed when an order is made for the sale by the board of county commissioners <br /> <br />Page NO.1 <br />
