WHEREAS, the original Joint Powers Agreement was amended on March 11, 002; and, WHEREAS, West Fargo desires that RRRDC provide dispatch services for the c'ty of West Fargo and has requested permission to be added as a party to the Joint Powers Agree ent, I as amended, and to be a voting member of the BOA; and, I WHEREAS, Fargo, Moorhead, Cass County, and Clay County now agree and cons~nt to , West Fargo being added as a named party to the Joint Powers Agreement and to becomtng a I voting member of the BOA; and, WHEREAS, the parties wish to set forth the terms and conditions governing their agreement and further intend that this agreement shall replace any prior agreements, NOW, THEREFORE, in consideration of the mutual promises and agree ents contained herein, the parties do hereby agree as follows: Unless specifically provided herein, this Joint Powers Agreement shall amendl and replace the Joint Powers Agreement as amended on March 11, 2002, and shall serve a the Amended and Reconstituted Joint Powers Agreement for the joint dispatch center, Althou this is intended to replace the prior joint powers agreement, as amended in 2002, nothing herein shall invalidate or nullify any actions prior to the effective date hereof. 1. Purpose. The purpose of this agreement is to establish a framework that a lows for the joint operation of 9111dispatch functions by the named parties. By combinin the communications and dispatch of said parties, the parties will benefit by reducing d/or ! eliminating duplication of equipment and staff time. The goal of this agreement is to redue the financial burden to the respective governments' taxpayers through the sharing of one communications center, as well as to improve communications services, 2. Duration and Notice to Terminate. Recognizing that all original parties t the Joint Power Agreement have contributed financially to the establishment and operati n of RRRDC for more than five years, the parties hereby agree that West Fargo may not withdr w as a party from this Agreement until five years from the date that this Agreement bec mes effective. Any party, other than West Fargo, may withdraw :from participation in this Agre ent upon giving written notice thereof to all parties at least one (1) year prior to the effective date upon which the party desires to terminate its participation in this agreement and upon the adoption of a resolution to that effect by the party's governing body. 2 I I JP A 12-16-07 v3 cleat). copy
