<br />MEMORANDUM OF UNDERSTANDING <br />BETWEEN THE <br />NORTH DAKOTA DEPARTMENT OF HEALTH <br />AND <br />FARGO CASS PUBLIC HEALTH <br /> <br />The North Dakota Department of Health, hereinafter referred to as the Department, hereby enters into an <br />agreement with Fargo Cass Public Health, hereinafter referred to as the Health Unit. The purpose of the <br />agreement is to promote sound public health practices in foodservice establishments, bars, bakeries, <br />retail meat markets, retail food stores, and other food establishments, lodging facilities and assisted living <br />facilities within the cites of Fargo and West Fargo and tanning facilities within Cass County and <br />tattoo/body art within Cass and Richland Counties. Another purpose of this agreement is to provide an <br />efficient and meaningful administration of the inspection and educational programs without duplication of <br />services. <br /> <br />AGREEMENT: <br />1. The Health Unit will: <br />a. Be responsible for the enforcement of all applicable local regulations, local ordinances, <br />State statutes, and Department rules relevant to the establishments identified in <br />subsection b. <br />b. Make available a listing, yearly, of all food establishments, bars, hotels, motels and <br />assisted living facilities within the city limits of Fargo and West Fargo in addition to tattoo <br />and tanning facilities within Cass County which will be routinely inspected by their <br />personnel. <br />c. Conduct at least one sanitary inspection per year of all establishments included within this <br />mutually agreed upon listing. The standards against which such inspections will be <br />conducted is the North Dakota Administrative Code (NDAC) Chapter 33-33-04 "Sanitary <br />Requirements for Food Establishments", North Dakota Century Code (NDCC) Chapter 19- <br />02.1, "North Dakota Food, Drug and Cosmetic Act", North Dakota Century Code (NDCC) <br />Chapter 23-09, "Food Establishments, Lodging Establishments and Assisted Living <br />Facilities" and North Dakota Administrative Code (NDAC) Chapter 33-39-01 "Lodging <br />Establishment Sanitation Standards", NDCC sections 23-01-35 and 12.1-31-13 and <br />NDAC 33-41 dealing with body art, and NDCC 23-39 and NDAC 33-42 dealing with <br />tanning facilities, in addition to any local regulations. <br />d. Investigate all complaints and potential foodborne disease outbreaks within their <br />jurisdiction and take appropriate action. <br />e. Provide assistance to the department in the investigation and abatement of complaints. <br />f. . Conduct plan reviews of all newly constructed, converted or extensively remodeled <br />foodservice establishments, bars, or other food establishments within their jurisdiction. <br />g. Be responsible for providing appropriate license applications and licenses to the <br />owners/operators. <br />h. Submit the following to the Division of Food and Lodging: <br />i. Reports or copies of the inspection reports upon request by the Department. <br />ii. Copies of public notices, license revocations and other regulatory action pertaining <br />to closures or penalties levied for ordinance violations at the time of such actions. <br /> <br />2. The Department will: <br />a. Waive the State license and all or a . potion of the license fee for any establishment <br />licensed and inspected by the Health Unit. <br />b. Provide copies of applicable State statues and Department rules. <br />c. Provide assistance in the investigation of food borne disease outbreaks or the investigation <br />and abatement of complaints. <br />d. Conduct inspection activities, upon request, in cooperation with Health Unit staff. <br />e. Provide expertise in statute/rule/code interpretation, implementation and enforcement. <br />
