1. Fargo Cass Public Health-tanning parlor regulations

MEMORANDUM OF UNDERSTANDING BETWEEN THE NORTH DAKOTA DEPARTMENT OF HEALTH AND FARGO CASS PUBLIC HEALTH The North Dakota Department of Health, hereinafter referred to as the Department, hereby enters into an agreement with Fargo Cass Public Health, hereinafter referred to as the Health Unit. The purpose of the agreement is to promote sound public health practices in foodservice establishments, bars, bakeries, retail meat markets, retail food stores, and other food establishments, lodging facilities and assisted living facilities within the cites of Fargo and West Fargo and tanning facilities within Cass County and tattoo/body art within Cass and Richland Counties. Another purpose of this agreement is to provide an efficient and meaningful administration of the inspection and educational programs without duplication of services. AGREEMENT: 1. The Health Unit will: a. Be responsible for the enforcement of all applicable local regulations, local ordinances, State statutes, and Department rules relevant to the establishments identified in subsection b. b. Make available a listing, yearly, of all food establishments, bars, hotels, motels and assisted living facilities within the city limits of Fargo and West Fargo in addition to tattoo and tanning facilities within Cass County which will be routinely inspected by their personnel. c. Conduct at least one sanitary inspection per year of all establishments included within this mutually agreed upon listing. The standards against which such inspections will be conducted is the North Dakota Administrative Code (NDAC) Chapter 33-33-04 "Sanitary Requirements for Food Establishments", North Dakota Century Code (NDCC) Chapter 19- 02.1, "North Dakota Food, Drug and Cosmetic Act", North Dakota Century Code (NDCC) Chapter 23-09, "Food Establishments, Lodging Establishments and Assisted Living Facilities" and North Dakota Administrative Code (NDAC) Chapter 33-39-01 "Lodging Establishment Sanitation Standards", NDCC sections 23-01-35 and 12.1-31-13 and NDAC 33-41 dealing with body art, and NDCC 23-39 and NDAC 33-42 dealing with tanning facilities, in addition to any local regulations. d. Investigate all complaints and potential foodborne disease outbreaks within their jurisdiction and take appropriate action. e. Provide assistance to the department in the investigation and abatement of complaints. f. . Conduct plan reviews of all newly constructed, converted or extensively remodeled foodservice establishments, bars, or other food establishments within their jurisdiction. g. Be responsible for providing appropriate license applications and licenses to the owners/operators. h. Submit the following to the Division of Food and Lodging: i. Reports or copies of the inspection reports upon request by the Department. ii. Copies of public notices, license revocations and other regulatory action pertaining to closures or penalties levied for ordinance violations at the time of such actions. 2. The Department will: a. Waive the State license and all or a . potion of the license fee for any establishment licensed and inspected by the Health Unit. b. Provide copies of applicable State statues and Department rules. c. Provide assistance in the investigation of food borne disease outbreaks or the investigation and abatement of complaints. d. Conduct inspection activities, upon request, in cooperation with Health Unit staff. e. Provide expertise in statute/rule/code interpretation, implementation and enforcement.
