CITY OF CASSELTON AND CASS COUNTY GOVERNMENT ELEVATOR ACCESS ROAD FUNDING AGREEMENT This agreement is between Cass County Government and the City of Casselton. BACKGROUND: This City of Casselton desires to secure financial assistance with the construction of a new road to serve a grain terminal expansion project. The North Dakota Department of Transportation is agreeable to providing a one time increase to Cass County's normal annual Federal Funding allotment to allow Cass County to assist the City of Casselton with the project. PURPOSE OF AGREEMENT: The purpose of this agreement is to outline the terms of the City- County partnership regarding the project. Cass County Obligations: 1. Cass County will provide County funds to be spent on the project in an amount equal to the special Federal Funds designated by the State Department of Transportation. The Federal Funds will be reserved for a future project on the Cass County Federal Aid Highway system. The Department of Transportation has currently committed $200,000 for this purpose. If this amount changes, the County's payment to the City of Casselton will reflect the change on a 1:1 basis. 2. In addition to providing an amount equal to the Special Federal Funds, Cass County will contribute $20,000 in County funds for the project. City of Casselton Obligations: Casselton will assume all responsibilitY for ownership, construction, and maintenance of the project. Cass County will, through its consultant, complete the project design phase. Design documents will be turned over to the City for procurement of construction services by the City or its consultant. General: All notices, certificates, or other communications shall be sufficiently given when delivered or mailed, postage prepaid, to the parties at their respective places of business as set forth below or at a place designated hereafter in writing by the parties.
