4. Transportation: The party of the second part shall be responsible for transportation to and fi.om the Jail <br /> of any prisoners which the party of the second part desires the party of the first part to detain at the Jail. Also refer <br /> to section on Medical Care. <br /> <br /> 5. Medical Care: It is expressly understood between the parties that the party of the first part will be <br />providing only detention of the said prisoners. However, routine medical care such as sick call, self care and <br />emergency assistance by persons trained in first aid procedures only shall be provided by the party of the first part as <br />part of the basic daily rate. Any additional expenditures shall be the expense of the party of the second part, <br />including, without limitation, expenditures for the medical care or treatment of and for any such prisoners. The <br />party of the second part expressly agrees to assume and pay for such expenditures as shall be necessary, including, <br />without limitation, medical care or treatment for any prisoners of the party of the second part detained in the Jail. <br />Necessary medical treatment shall include emergency care and life threatening situations or such treatment or <br />medications as may be required in order to maintain the health or well being of the prisoner while incarcerated, <br />including but not limited to, emergency room care, hospitalization, prescriptions, surgery, or ambulance service. <br />Necessary medical treatment shall not include elective medical or dental care which would normally be provided by <br />the prisoner, which shall not be provided in any case. <br /> <br /> The party of the second part is responsible for transportation to and fi.om the detention facility for medical <br />purposes. Should the party of the second part request and the party of the first part has staffavailable~ the party of the <br />second part agrees to reimburse the party of the first part for transportation to and fi.om the detention facility for <br />medical purposes. The reimbursement amount shall be the actual cost incurred, such as emergency ambulance care <br />costs, or ifa Cass County vehicle is utilized, then the reimbursement amount shall be at the rate of 31 cents per mile. <br />In addition, the party of the second part shall reimburse the party of the first part at the rate of Thirty-Five Dollars <br />($35.00) per man hour, with a three hour minimmn~ for each correctional officer or sworn law enforcement officer <br /> <br />Pa~e 2 of 4 <br /> <br /> <br />
