AGREEMENT THIS AGREEMENT is made and entered into this ~ day of ~_/t~~ ), 2003, by and between Cass County Government, by and through the Cass County Sheriffs Department, State of North Dakota (hereafter "party of the first part") and City of Fargo (hereafter "party of the second part"). WITNESSETH, that for and in consideration of the mutual covenants and agreements herein contained, the parties agree as follows: 1. Scope of Service: The party of the lb'st part shall provide a class one correction facility for the holding of prisoners, and all necessary and incidental services associated with such detention of prisoners, at the Cass County Jail (hereafter "Jail") located at Fargo, North Dakota. The party of the second part may utilize the Jail of the party of the first part for the holding and housing of prisoners of the party o£the second part. 2. Payment: The party of the second part shall pay the party of the first part an initial booking fee often Dollars ($10.00) per prisoner and at the rate of Sixty Dollars ($60.00) per day per prisoner, wkich rate shall apply for any day or any part of any one 24-hour period (midnight to midnight) during which any prisoner of the party of the second part shall be housed in the Jail. 3. Term: The term of this Agreement shall be continuous provided, however, that it may be modified or cancelled only upon thirty (30) days written notice by either party. All changes or modifications shall be subject to the written approval of both of the parties. In any event, this agreement shall remain in full force and effect until modified or cancelled by one or both parties.
