<br />Commission Minutes-November 19, 2007 3291 <br /> <br />Mr. Stewart said the initial application was for an amount not to exceed $102,000,000; <br />however, the state has allocated $58,000,000 for the solid waste component and with the <br />approval today, $58,000,000 will be issued for the project. <br />MOTION, passed <br />Mr. Bennett moved and Mr. Pawluk seconded to adopt a Resolution <br />Approving the Issuance of Solid Waste Disposal Revenue Bonds <br />(Tharaldson Ethanol Plant I, LLC Project) Series 2007. On roll call vote, <br />the motion carried unanimously. <br /> <br />8. COURTHOUSE WEST ADDITION, Contract addendum approved with Foss <br />Architecture & Interiors <br />Mr. Wagner said the building committee has been meeting every month and recommended <br />a contract addendum for a courthouse addition with Foss Architecture & Interiors be <br />forwarded to the county commission. He said a contract was approved by the board in <br />2001 and prior work on schematic designs was completed by Foss. The addendum <br />includes a revised construction budget of $9 million and the project scope may be revised <br />through direction of the building committee with final approval from the county commission. <br />The county has $8.3 million in the building fund. Rick Hoganson, Foss Architecture & <br />Interiors, was present. <br /> <br />Mr. Wagner reviewed the compensation terms outlined in the addendum, which is 7.5% of <br />actual construction costs based on an estimated budget of $9 million. The original contract <br />was a fixed fee, which when calculated to a percentage, was approximately 7.75%, <br />according to Mr. Hoganson. The county will be given credit for $57,369 already paid to <br />Foss for the previous work they completed in 2001. The addendum also includes a <br />proposal in the amount of $62,100 from Kimme & Associates for security consulting, courts <br />programming and planning related expenses. The North Dakota Supreme Court has <br />agreed to provide $25,000 to help pay for court consulting fees. <br /> <br />Mr. Hoganson said Kimme & Associates will be able to provide the expertise needed on <br />security and court room designs. If the county approves the contract addendum, past <br />information will be used to create new schematic designs to serve county needs into the <br />future. Mr. Hoganson said his firm will provide sufficient information to the county <br />commission regarding cost estimates and space allocations during the planning process. <br />Mr. Pawluk questioned the timeline and Mr. Hoganson said Kimme & Associates is available <br />after January 1 st and believes the work may take two to three months to complete. <br /> <br />Mr. Bennett prefers the county pay 7% of actual construction costs. Mr. Hoganson said if <br />the scope of work changes (Le. increased budget), Foss would be willing to have a <br />discussion at that time. <br />MOTION, passed <br />Mr. Vanyo moved and Mr. Bennett seconded to approve an addendum to <br />the original contract with Foss Architecture & Interiors dated June 11, <br />2001, for the Courthouse West Addition, subject to state's attorney <br />approval. On roll call vote, the motion carried unanimously. <br /> <br />9. HEAD START BUILDING, Auditor authorized to solicit proposals <br />County Auditor Michael Montplaisir said the Southeastern North Dakota Community Action <br />Agency (SENDCAA) chose not to renew their occupancy lease for county-owned property at <br />57 11tt\ Avenue North in Fargo.
