Butler Machinery Company will undertake to carry out. at regular intervals, scheduled maintenance to the product listed, as established by the manufacturer's lubrication and maintenance guidelines. Butler Machinery Company will provide all fluid elements, fluid filters, gaskets, seals and fluids required for such servicing at the cost listed on this agreement. 2. Butler Machinery Company is responsible for listed intervals of maintenance and inspections. No cleaning is included. 3. Butler Machinery Company will undertake the implementation of the Butler SOS Program during the recommended interval. Customer 1. The customer undertakes that the product shall be made available to Butler Machinery Company for services scheduled by agreement between Butler Machinery Company and the customer. In the event that the product is not made available to Butler Machinery Company's representative. the customer will pay Butler Machinery company in respect to waiting, and travel time at Butler's normal field service charge out rate. 2. Customer agrees to provide Butler Machinery Company with accurate product hours/miles upon request or at an established interval. 3. Customer is responsible for cleaning, daily and weekly maintenance and inspections. 4. Customer agrees to comply with the product manufacturer's Operation, Lubrication and Maintenance Guidelines. 5. In the event that any problems that affect product operation occur, the customer agrees to contact Butler Machinery Company as soon as possible. General 1. Applicable local, state and federal taxes are not included in prices listed, and will be added to each invoice as they apply. 2. This agreement covers preventive maintenance only. All repairs, including acts of nature, fire, theft. vandalism, accident and abuse are specifically excluded from this agreement. Charges for the above items will be billed at the standard published rates. 3. Prices are effective for term of contract unless otherwise stated. 4. This agreement does not provide for a loaner or replacement product. 5. This agreement may be terminated by either party with 30 day written notice. Failure to provide proper notice at the agreement term will provide automatic renewal at current parts & labor prices. 6. The services to be performed under this agreement are not a guarantee against obsolescence or normal wear. Nor shall inspections be construed as an approval or guarantee of the condition of the equipment.
