<br />Commission Minutes-November 5, 2007 3285 <br /> <br />MOTION, failed <br />Mr. Pawluk moved and Mr. Bennett seconded to approve a request to <br />direct the county engineer to purchase three acres of land at a cost of <br />$9,000 in Section 13, Raymond Township. Discussion: Mrs. Sorum does <br />not support the motion without knowing more information about the <br />township's role in the situation. Mr. Vanyo asked what assistance the <br />county provided during flooding in 2006. Mr. Berndt said the eroded <br />areas were pushed back and the soil was seeded in 2006. On roll call <br />vote, the motion failed with Mr. Wagner, Mr. Vanyo and Mrs. Sorum <br />voting "No"; Mr. Pawluk and Mr. Bennett voting "Yes". <br /> <br />10. ROAD DEPARTMENT, Contract approved with Mark Sand & Gravel to lease unloadina <br />facility in Durbin Township <br />Mr. Berndt said Mark Sand & Gravel Company is supplying gravel to the Tharaldson <br />Ethanol Plant project near Casselton and normally rails their gravel from Lisbon to an <br />unloading site they own at Casselton; however, use of this site is limited because of the <br />adjacent grain elevator loading trains and Mark Sand & Gravel has requested to lease the <br />county-owned unloading facility in Durbin Township through 2007. Mr. Berndt said the <br />county has completed gravel operations for the season. If the contract is approved, the <br />county will be paid $500 for each train load of gravel unloaded at the site. <br />MOTION, passed <br />Mr. Pawluk moved and Mr. Vanyo seconded to authorize the chairman to <br />sign a contract with Mark Sand & Gravel Company and lease a county- <br />owned gravel unloading facility in Durbin Township, subject to state's <br />attorney approval. Discussion: The state's attorney asked about <br />county liability if something happened to the conveyor and Mr. Berndt <br />said he will address this issue with the lessee. Mr. Bennett suggested <br />the cost per load specify the number of train cars and Mr. Berndt said <br />he will amend the agreement to specify 15 cars per train load. On roll <br />call vote, the motion carried unanimously. <br /> <br />11. GIS AGREEMENT WITH CITY OF FARGO, Aareement mutually terminated <br />Kay Anderson, Geographical Information Systems (GIS) Coordinator, was present to <br />discuss the GIS agreement between the City of Fargo and Cass County. She said several <br />changes have occurred over the past two years due to the addition of a GIS Technician and <br />changes to software and data server configurations. The county now has sufficient staff <br />capable of completing tasks currently performed by the City of Fargo. She said differences <br />in technology are causing redundancy and introducing errors into the database. The <br />common goal is to provide the most efficient data and she said the county and city will <br />continue to work together. She said the City of Fargo is aware of the change and has <br />mutually agreed to terminate the contract effective December 31,2007. <br />MOTION, passed <br />Mr. Vanyo moved and Mr. Pawluk seconded to authorize the chairman to <br />sign a letter to terminate the Geographic Information Systems (GIS) <br />agreement between Cass County Government and the City of Fargo <br />effective December 31, 2007. On roll call vote, the motion carried <br />unanimously. <br />
