On roll call vote, motion carried unanimously. 9. D~ED TRANSACTION DELAYED, Highway 81 right-of-way . This item was moved from the consent agenda to the regular agenda for discussion: Mr. Berndt recommended deeding approximately three acres of old right-of-way along Highway 81 in the SEX of Section 15, Reed Township, back to the adjacent landowner, Luella __ becau,se the property is no longer used as highway right of way. Mr. Meyer asked if the county could be compensated for the property atthe purchase price . when it was acquired. In a letter to the County Engineer from the former State's Attorney, it was stated that the..county paid $296 for acquisition of the property. The Board questioned whether' thet land has value to anyone other than the adjacent landowner. Birch Burdick, State's Attorney, said he has not done any study to determine if the county has legal interest or ownership in the property, however, the quit claim deed would be granting whatever interest the county may have, subject to any conditions that may be upon it. MOTION, passed Mr. Meyer moved and Mr. Koenig seconded to delay action on the q':-lit claim deed concerning property in the SE 1/4 of Section 15 Township " 140 North Range 49 West, no longer used as highway right-of-way, until further review and recommendation by the State's Attomey. Discussion: Mr. Meyer said he is interested in the legal ownership ~f the property and if anyone else would be interested in it, other than the former owner. Motioo carried. 10. FLOOD UPDATE, Acquisition proiect close-out: River Keepers input The County recently received a letter from the North Dakota Division of Emergency Management asking that Cass County finalize all housing acquisitions including demolition by May 31, 1999. Mrs. Quick asked Irv Rustad, Lake Agassiz Regional CounGil,to appear before the Board for an update. Me Rustad said he has an advertisement in the newspaper for the sale of the most recently acquired properties, and he has been contacted by three moving companies about the deadline. He has talked to the County Engineer about spring road restrictions, and Commissioners were in agreement that some of the homes may have to be moved off their foundations and temporarily placed on other county-owned lots in the interim so the demolition work can be completed and holes filled up with dirt. Once spring road restrictions are lifted, the homes can be moved to the buyer's permanent location. Regarding the disposition of county buy-out properties, Keith Berndt has been contacted by Bob Backman, Executive Director of River Keepers, who was present today to talk about future uses. Mr. Backman shared some ideas with the Commission on possible uses, such as green space, bike paths, bird sanctuaries, wildlife learning sites, primitive rest areas for those canoeing the Red River, as well as the possibility of facilitating planting of trees and shrubs by student
