Transportation to and from the detention facility for medical purposes shall be the responsibility of the City. Should the City request the County, and the County has staff available to handle such transportation, the City will reimburse the County the actual cost incurred, such as emergency ambulance care costs, or if a Cass County vehicle is utilized, COUNTY shall be reimbursed at the rate of 31 cents per mile. In addition, the City shall reimburse the County at the rate of $35 per man hour for each correctional officer or sworn law enforcement officer provided by the County to supervise an inmate outside the detention facility. 6. CITY shall have the right to enter the Cass County Jail at reasonable hours for the purpose of inspecting and ascertaining conditions under which CITY'S prisoners are detained. 7. The decision to lodge either a CITY pre-trial detainee or sentenced CITY prisoner, whether from Municipal Court or resulting from a transfer case from Municipal Court to District Court, in the COUNTY'S detention facility lies employees, agents or assigns, and the specifically limited to responsibility solely with the CITY, its liability of COUNTY is for deprivation of an inmate's constitutional rights or for willful acts or omissions which result in physical injury to an inmate during the term of detention.
