Department within a reasonable time if a CITY prisoner is incurring <br />medical expenses or has been transferred to a medical facility. <br /> <br /> 5. Transportation to and from the detention facility for <br />medical purposes shall be the responsibility of the City. Should <br />the City request the County, and the County has staff available to <br />handle such transportation, the City will reimburse the County the <br />actual cost incurred, such as emergency ambulance care costs, or if <br />a Cass County vehicle is utilized, COUNTY shall be reimbursed at <br />the rate of 31 cents per mile. In addition, the City shall <br />reimburse the County at the rate of $35 per man hour for each <br />correctional officer or sworn law enforcement officer provided by <br />the County to supervise an inmate outside the detention facility. <br /> <br /> 6. CITY shall have the right to enter the Cass County Jail <br />at reasonable hours for the purpose of inspecting and ascertaining <br />conditions under which CITY'S prisoners are detained. <br /> <br /> 7. The decision to lodge either a CITY pre-trial detainee or <br />sentenced CITY prisoner, whether from Municipal Court or resulting <br />from a transfer case from Municipal Court to District Court, in the <br /> <br />COUNTY'S detention facility lies <br />employees, agents or assigns, and the <br />specifically limited to responsibility <br /> <br />solely with the CITY, its <br /> <br /> liability of COUNTY is <br /> <br /> for deprivation of an <br /> <br />inmate's constitutional rights or for willful acts or omissions <br />which result in physical injury to an inmate during the term of <br />detention.
