AGREEMENT <br /> <br /> THIS AGREEMENT, to become effective the 1st day of January, <br />2004, by and between the County of Cass, State of North Dakota, <br />hereinafter referred to as "COUNTY"; and the City of West Fargo, <br />State of North Dakota, hereinafter referred to as "CITY"' <br /> <br />PREMISES: <br /> <br /> 1. <br /> <br /> 2. <br /> <br /> 3. <br /> <br /> CITY does not have facilities for detention of prisoners. <br /> COUNTY does have suitable facilities for such detention. <br /> <br /> Duplication of facilities would be uneconomical and <br />contrary to the best interests of the taxpayers of COUNTY and CITY. <br /> <br /> 4. COUNTY has agreed to incarcerate prisoners for CITY at <br />an agreed daily rate. <br /> <br /> 5. CITY has agreed to pay certain additional costs which may <br />be incurred by COUNTY. <br /> <br /> NOW, THEREFORE, it is hereby agreed as follows: <br /> <br /> 1. COUNTY agrees to provide for the use of CITY, detention <br />facilities for the holding of pre-trial detainees and sentenced <br />prisoners from Municipal Court and any sentenced prisoners <br />resulting from a transfer case from Municipal Court to District <br />Court, and all necessary and incidental services associated with <br />such detention of such inmates at the Cass County Jail located in <br />Fargo, North Dakota. <br /> <br /> 2. Parties hereto understand and agree that the COUNTY'S <br />obligation to house prisoners of CITY shall be subordinate to the <br /> <br /> <br />
