Expensee: <br /> <br /> Supplies, material costs, direct project costs, sub consultant and testing charges by an <br /> approved independent testing firm will be payable on an aotual cost basis and per Billing <br /> schedule. <br /> <br />Bo <br /> <br />Payment Schedule: Payments to the engineer will be made by the County upon receipt from <br />the engineer of monthly vouohere. <br /> <br />Phase I: 100% when complete. <br /> <br />Phase II: Payment per following schedule: <br /> <br />50% - Preliminary plans at 50% <br />50% - Final plans <br /> <br /> Phase I~1 <br /> Payment for actual labor ,testing and expenses completed, billed monthly. <br /> <br />The County shall remit full payment of approved invoices within 30 days of invoice receipt. <br /> <br /> III. <br /> <br />Cost principles and allowable costs am covered under Title 48 CFR Part 31, and procurement procedures <br />are covered under Title 49 CFR Part 18. <br /> <br />IV. <br /> <br />Duly authorized representatives of the County, NDDOT and Federal Highway Administration (FHWA) <br />shall have the right to inspect and copy the engineer's files and records relating to the work included tn <br />this agreement. <br /> <br />On federal aid projects, the engineer shall furnish to NDDOT all project records and documents including, <br />but not limited to, diary, quantity books, and haul tickets. <br /> <br />All books, documents, papers, accounting records, and other evidence pertaining to the costs incurred <br />under the agreement and all plans, files, records, and field notes pertaining to the project shall be <br />retained by the engineer and kept available for inspection by NDDOT or FHWA for a period of three years <br />after the date of final payment. Unless any litigation, claim or audit is started before the expiration of the <br />three years, then the re~ords shall be retained until such action is satisfied in accordance with the "Single <br />Audit Act of 1984', Public Law 98-502. <br /> <br />These files and records shall be available in the engineer's office located et 1042 14th Avenue East, Suite <br />101, West Fargo, North Dakota. <br /> <br />Final inspection and project acceptance shall De made by the County Engineer, NDDOT's district <br />engineer and by FHWA. The engineer shall be responsible to the County Engineer and Inform the <br />County of project progress and all changes and problems on the project. <br /> <br />VI, <br /> <br />No change in the type or extent of the work to be performed by the engineer shall be made except by <br /> <br /> <br />
