Planning Commission Minutes – October 27, 2022 4 <br /> <br />There has not been a residence on this lot since the 1950’s. The township has approved the <br />building permit. There was a house move permit that was approved by the Cass County Highway <br />Department. <br /> <br />The Lilleberg’s have been notified that the current and new home is near the flood zone. Mr. <br />Benson would like a geotechnical study done to obtain information about the soil before <br />approving this application. Commissioner Scherling made a comment that she has seen many <br />instances of ground slumping and we do not want to set a precedent for others to build near flood <br />zones. <br /> <br />Mr. Gust said he would like to table this item until a geotechnical study can be reviewed. He also <br />said that the Flood Plain Administrator should have either put a stop to this or gotten a study from <br />the state. <br /> <br />Mr. Lougheed said that we do want people to use their lands as they wish, but in a safe manner. <br />Mr. Benson said even after the diversion is complete, the property will be surrounded by water <br />during flood events. <br /> <br />Dr. Mahoney left the meeting at 7:48 am. <br /> <br />Upon hearing no further public comments, the public hearing was closed. <br />MOTION, tabled <br />Mr. Gust moved, and Dr. Mahoney seconded to table this item until the geotechnical <br />study can be reviewed by the Planning Commission. <br /> On a roll call vote with all in favor, motion carried. <br /> <br />F. NEW BUSINESS <br />Senior Attorney Kate Naumann is replacing Tracy Peters who is now the Human Resources <br />Director/Assistant County Administrator. The Commissioner’s expressed gratitude of having her attend <br />meetings and provide legal guidance. Ms. Peters said there is a definite need to have an attorney <br />present at these meetings, due to the increase of issues that do come up. <br /> G. OLD BUSINESS <br />Reminder about the date of the November/December meeting. <br /> <br />H. ADJOURNMENT <br />On motion by Mr. Gust seconded by Ms. Schipper and all voting in favor, the meeting was adjourned at <br />7:52 am. <br /> <br />Minutes prepared by Lisa Shasky, Principal Secretary, Cass County Highway Department.
