Planning Commission Minutes – October 27, 2022 2 <br /> <br /> Mr. Gust moved and Mr. Gohdes seconded to accept the findings and recommend <br />approval to the County Commission with any conditions outlined by the County <br />Planner. <br /> On a roll call vote with all in favor, motion carried. <br /> <br />2. Hearing on an application requesting a Minor Subdivision Plat of C.C. Third Subdivision located <br />in Section 5, Township 138 North, Range 50 West of the 5th Principal Meridian, Warren <br />Township, Cass County North Dakota. <br />Mr. Lougheed opened the public hearing. <br /> <br />This was a previously tabled agenda item. <br /> <br />The applicant is seeking approval of a minor subdivision entitled C.C. Third Subdivision to plat a <br />two (2) Lot subdivision of approximately 4 acres. According to the applicant, the subdivision is <br />requested to create a lots for a farm shop on each. One lot would be for son. <br /> <br />The proposed ownership and maintenance responsibility of the subdivision will be private. The <br />subdivision will use a new 165th Ave SE (County Road 15) road access, ditches for storm sewer <br />conveyance, rural water, and onsite septic systems for wastewater treatment. <br /> <br />Randy Hajek and Don Westman appeared on behalf of Warren Township. They have concerns on <br />what exactly is being built on this property. Previously the property was to be used for an airport <br />park. The township has not seen any building plans from Mr. Christianson, and he has not <br />contacted the township for any conversations regarding building. Mr. Westman was unclear why <br />the county had approved the subdivision. It was explained that the township has the last say on <br />what is being built and the county does not have anything to do with their zoning ordinance. Cass <br />County Planning Commission only approves land to be subdivided. Mr. Christianson would not <br />be able to subdivide this land again. It was advised that Warren Township ask their attorney to <br />contact Mr. Christianson to submit a building permit. The Planning Commission discussed that it <br />would be best to wait to approve the subdivision application until Mr. Christianson provides a <br />building permit to the township. <br /> <br />Upon hearing no further public comments, the public hearing was closed. <br />MOTION, tabled <br /> Mr. Gust moved, and Mr. Gohdes seconded to approve this item on the condition that <br />the township will receive building permits and sign the plat. Once the building permit is <br />received and approved, then the subdivision approval process will continue. <br /> On a roll call vote with all in favor, motion carried. <br /> <br />3. Hearing on an application requesting a Minor Subdivision Plat of Sorby Subdivision located in <br />Section 2, Township 137 North, Range 49 West of the 5th Principal Meridian, Pleasant <br />Township, Cass County North Dakota. <br />Mr. Lougheed opened the public hearing. <br /> <br />The applicant is seeking approval of a minor subdivision entitled Sorby Subdivision to plat a one <br />(1) Lot subdivision of approximately 15.6 acres. According to the applicant, the subdivision is <br />requested to split the land between David & Lucy Sorby Irrevocable Trust and Gary and Diane <br />Meyer.
