Planning Commission Minutes – August 18, 2022 2 <br /> <br />2. Hearing on an application requesting a Minor Subdivision Plat of Jahnke Second Subdivision <br />located in Section 3, Township 138 North, Range 52 West of the 5th Principal Meridian, Maple <br />River Township, Cass County North Dakota. <br />The applicant is seeking approval of a minor subdivision entitled Jahnke Second Subdivision to <br />plat a one (1) Lot subdivision of approximately 4.463 acre. According to the applicant, the <br />subdivision is requested to create a lot for a house to be built on. <br /> <br />The proposed ownership and maintenance responsibility of the subdivision will be private. The <br />subdivision will use an existing 42nd St SE road access, ditches for storm sewer conveyance, rural <br />water, and on-site septic systems for wastewater treatment. <br /> <br />Ms. Puppe explained that a variance request was received by the Planning office on 9/21/22 and <br />provided the Planning Commissioners a copy for review. There are two houses and one new house <br />on the parcel. There is a fourth house on the parcel but is inhabitable. A variance is requested to <br />allow three residences within a tract of land that is less than 120 acres, the rest is agricultural with <br />no plans for development. Mr. Belter an adjacent property owner initially did not want to sign the <br />deed restriction because he wants the family to be able to build. <br /> <br />Upon hearing no further public comments, the public hearing was closed. <br />MOTION, tabled <br /> Dr. Mahoney moved, and Commissioner Scherling to table this application until October <br />meeting for time for applicant to look at existing land owned to try to satisfy the deed <br />restriction requirements. <br /> On a roll call vote with all in favor, motion carried. <br /> <br />3. Hearing on an application requesting a Minor Subdivision Plat of Groucho’s Corner Subdivision <br />located in Section 14, Township 139 North, Range 51 West of the 5th Principal Meridian, Durbin <br />Township, Cass County North Dakota. <br />Mr. Lougheed opened the public hearing. <br /> <br />The applicant is seeking approval of a minor subdivision entitled Groucho’s Corner Subdivision to <br />plat a one (1) Lot subdivision of approximately 17.89 acres. According to the applicant, the <br />subdivision is requested to split the existing pastureland off from the ag land and add it to the <br />farmstead. <br /> <br />The proposed ownership and maintenance responsibility of the subdivision will be private. The <br />subdivision will use an existing 38th St SE road access, ditches for storm sewer conveyance, public <br />water, and on-site septic systems for wastewater treatment. <br /> <br />Mr. Gohdes said that this is a neighbor of his. This area has wetlands and the applicant is wanting <br />to add pasturelands and will not be adding any structures. Mr. Gust asked if this will be platted as <br />a single lot. Ms. Puppe confirmed it would be. <br /> <br />Upon hearing no further public comments, the public hearing was closed. <br />MOTION, passed <br />Mr. Bertsch moved, and Ms. Schipper seconded to accept the findings and recommend <br />approval to the County Commission with any conditions outlined by the County <br />Planner.
