Since this location is at the extremity of that part of our system a <br />hydraulic analysis would need to be performed at the time an application for service <br />is made. No application for service has been made to date. <br />North Dakota Department of <br />Transportation No comments were received prior to publishing the staff report. <br />County Sanitarian No issues with this subdivision as proposed. <br />Township Chairman <br />Farm Accessory buildings and structures are an allowable use under Warren <br />Township’s Agricultural District Zoning Regulations (5.1.2). Complies with the <br />zoning regulations for lot area and lot width (5.1.4). Should the subdivision be <br />moved to along 42nd st, the applicant will be required to obtain a permit for access <br />to the township road (3.7). 4. So long as the expressed intention for use by the <br />applicant remains the same, the subdivision appears to be in compliance with <br />Township’ zoning ordinances. The Applicant is reminded of the requirements for <br />road and highway setbacks-Tree Plantings, Shelterbelts, Building/Electrical/Fire <br />/Plumbing and other applicable building codes; the rules governing agricultural <br />districts; Yard Requirements and Building Height Requirements; as well as all other <br />applicable rules in the Warren Township Zoning Ordinances. Said ordinances will <br />be strictly enforced. <br />The City of Fargo <br />The proposed C.C. Fourth Subdivision is located in Section 5 of Warren Township. <br />This location is outside of Fargo’s city limits and extra-territorial jurisdiction (ETJ). <br />We have no comment <br />The City of West Fargo No comments were received prior to publishing the staff report. <br />Public Comment No comments were received prior to publishing the staff report. <br />. <br />Staff Analysis <br />Land Use and Surrounding Uses <br />The subject property is bound by agricultural production land on the west and south with residential lots to the <br />north. County Road 15 borders the east of the property. <br />Floodzone <br />According to the FEMA Flood Map Service Center, this property is not in a Special Hazard Flood Area. In <br />addition, no wetlands or other notable features are present on the proposed subdivision Lot. <br />Land Development Rights <br />The subject quarter-quarter section currently is developed and requires the transfer of a development right. <br />Section 308 of the Cass County Subdivision Ordinance states that every quarter-quarter section is granted one (1) <br />Development Right to create a buildable lot with a minimum of 40 acres. Because the lot subdivision proposal is <br />less than 40 acres, a transfer of a development right is required along with a deed restriction. <br />Staff Recommendation <br />To accept the findings and recommendations of staff and recommend approval to the County Commission of the <br />subdivision application as the proposal meets the goals and objectives of the Cass County Comprehensive Plan,
