June 16, 2022 <br />51 <br /> <br />recommendations of the board of township supervisors shall not be binding on the Board of <br />County Commissioners. <br />3. The receipt of a Final Plat meeting all conditions established by the Planning Commission <br />and all necessary information and materials prepared in accordance with this Ordinance. <br />4. In determining whether a plat shall be finally approved or disapproved, the Board of County <br />Commissioners shall inquire into the public use and interest proposed to be served by the <br />subdivision. It shall determine if appropriate provisions are made for the public health, <br />safety, and general welfare, for open spaces, drainage ways, streets, alleys, other public <br />ways, water supplies, sanitary wastes, parks, playgrounds, sites for schools and school <br />grounds, but its determination is not limited to the foregoing. The Board of County <br />Commissioners shall consider all other relevant facts and determine whether the public <br />interest will be served by the subdivision. If it finds that the proposed plat makes <br />appropriate provisions for the public health, safety, and general welfare and for such open <br />spaces, drainage ways, streets, alleys, other public ways, water supplies, sanitary wastes, <br />parks, playgrounds, sites for schools and school grounds, and that the public use and <br />interest will be served by the platting of such subdivision, and that the proposed plat <br />complies with this Ordinance, such plat shall be finally approved with such conditions as the <br />Board of County Commissioners may deem necessary. If it finds that the proposed plat does <br />not make appropriate provisions, or that the public use and interest will not be served, or <br />that the proposed plat does not so comply with this Ordinance, then the Board of County <br />Commissioners shall disapprove the proposed plat. Dedication of land to any public body <br />may be required as a condition of subdivision approval and shall be clearly shown on the <br />final plat. <br />(r) Final Plat Recordation. Upon approval and certification of a final plat by the Board of <br />County Commissioners, the applicant shall record the approved final plat in the office of <br />the Cass County Recorder of Deeds. <br />Section 6.02 Major Subdivision Sketch Plan Content <br />(a) An individual seeking to divide land within the subdivision jurisdiction of Cass County may <br />provide a sketch plan to the County Planner in order to verify the process and application <br />requirements needed for plat review. It is recommended that a meeting be scheduled <br />with the County Planner to discuss the review process and proposed division of land. <br />(b) The sketch plan should include at least the following information. <br />1. Name and address of the landowner, and the developer (if different than the landowner). <br />2. Name of the individual and firm that prepared the sketch plan. The sketch plan may be <br />prepared by the landowner or developer, but must meet the following requirements. <br />3. Location map with labels showing the location of the land proposed to be platted and the <br />sections adjacent to it. <br />4. Existing parcel boundaries accurately labeled with the names of adjacent property owners <br />and adjacent plats. <br />5. Existing zoning of the land proposed to be platted and the land within 1,320 feet of it.
