June 16, 2022 <br />49 <br /> <br />2. The final plat application demonstrates conformance with all conditions of a preliminary plat <br />approval from the Planning Commission. <br />3. Either paragraph (1) or (2) occurs and the final plat application proposes a change to the <br />approved preliminary plat that is determined by the Planning Commission to be insignificant <br />because it does not change any impact to the surrounding properties. <br />(j) The application for Final Plat Approval may be submitted in sections of the preliminary <br />plat approved by the Planning Commission in the case that at least 25% of the total <br />number of lots on the approved preliminary plat are included in the final plat application, <br />except that the last possible Final Plat application may be for a smaller number of lots. <br />(k) Required final plat application documents include: <br />1. An application form (obtained from the County Planning Office) completely and property <br />executed with all information legible and bearing all required signatures. <br />2. A final plat containing all required information <br />3. A filing fee consisting of a check or money order draw to the Cass County Highway <br />Department. <br />4. One copy of all supplemental information not included on the final plat. <br />5. An attorney’s opinion of title or similar document. <br />County staff shall have 7 days from the date of submission of an application to check the <br />documents to determine if on their face they are in proper form and contain all the <br />information required by this Ordinance. If defective, the application may be returned to <br />the applicant with a statement that the application is incomplete; otherwise the <br />application shall be deemed accepted as of the date of submission. <br />(l) Final Plat Review. Upon acceptance of a final plat application, the following steps will be <br />completed as part of the plat review process: <br />1. A copy of the completed application documents will be sent by certified mail to the relevant <br />township soliciting comments <br />2. Copies of the completed application documents will be distributed to each of the following, <br />when relevant, for review and comment: <br />a. Cass County Engineer <br />b. Cass County Planning Commissioners. <br />c. Water Resource District. <br />d. Electric company. <br />e. Telephone company. <br />f. Gas Company. <br />g. Cass Rural Water Users. <br />h. North Dakota Department of Transportation (if the subject site abuts a State road). <br />i. County Sanitarian. <br />j. Adjoining municipality (if site is located within one (1) mile of a municipal or ET <br />boundary). <br />3. The County will notify the applicant or representing agent and all landowners within a <br />minimum of 1,000 feet of the proposed final plat that the application is under review and <br />will be considered by the Planning Commission at a public hearing on a specified date.
