The County Planner will schedule the Preliminary Plat application for action at a regularly <br />scheduled public meeting within ninety (90) days of the first public meeting of the Planning <br />Commission after the date of filing. <br />5. The County Planner will prepare a report of findings pertaining to the consistency of the <br />proposed plat with this Ordinance and noting any comments or concerns raised by the <br />relevant township or other reviewing parties. <br />(d) Planning Commission Action. At a regularly scheduled Planning Commission meeting, <br />following the closure of the relevant public hearing, the Planning Commission shall <br />consider the reported findings and received public comment and shall make a <br />determination if the requested plat is consistent with this Ordinance. The Planning <br />Commission shall take an action to recommend denial of the application, approval of the <br />application, or approval of the application with conditions. <br />(e) Notification of Commission Action. Within fifteen (15) consecutive days after the meeting <br />at which the Preliminary Plat application is reviewed, the county staff shall send written <br />notice of the Planning Commission’s action to the following: <br />1. Landowner or his agent. <br />2. Applicant. <br />3. Firm that prepared the plan. <br />4. Township Chairman. <br />If the application is disapproved, the staff will notify the above individuals, in writing, of <br />the defects in the application and will identify the requirements which have not been <br />met and citing the provisions of the statute or ordinance relied upon. <br />(f) Compliance with Planning Commission Action. If the Planning Commission conditions its <br />Preliminary Plat approval upon receipt of additional information, changes and/or <br />notifications, such data shall be submitted and/or alterations noted on two (2) copies of <br />the Plan to be submitted to the county staff for approval. <br />(g) Planning Commission Approval. Approval of a preliminary plat application shall <br />constitute approval of the proposed subdivision as to the character and intensity of <br />development and the general arrangement of streets, lots, structures, and other planned <br />facilities, but shall not constitute Final Plat approval. The Preliminary Plat may not be <br />recorded in the office of the Cass County Recorder of Deeds. <br />(h) Preliminary Plat Approval Duration. Preliminary Plat approval will be effective for a one <br />(1) year period from the date of the Planning Commission’s approval of the Preliminary <br />Plat application; therefore, Final Plat applications for the entire project must be filed <br />within one (1) year of Preliminary Plat approval unless the Planning Commission grants a <br />variance by extending the effective time period of the approval. <br />(i) Final Plat Application – Major Subdivision. An application for Final Plat Approval for a <br />Major Subdivision may be submitted only when one of the following is true: <br />1. The final plat application is consistent in all respects with an unconditional preliminary plat <br />approval from the Planning Commission.
