Earth or paved interceptors and diversions shall be installed at the top of cut or fill <br />slopes where there is a potential for erosive surface runoff. <br />4. In order to prevent pollution of any watercourse and to reduce erosion of soil, sediment <br />control devices shall be installed prior to any grading, filling, or excavation. Such devices <br />shall be designed to retain sediment on the site or flowing adjacent to the site. <br />5. Within thirty (30) days after completion of grading, all surfaces disturbed by vegetation <br />removal, grading, haul roads, or other construction activity that alters natural vegetative <br />cover, are to be revegetated to control erosion, unless covered with impervious or other <br />improved surfaces authorized by approved plans. Erosion controls may include any <br />combination of approved engineering or vegetative measures using the NDDOT Erosion and <br />Sediment Control Handbook, as it presently exists or may hereafter be amended. <br />6. In addition to the above requirements no subdivision shall involve uses, activities or <br />improvements which would entail encroachment into, the regrading of, or the placement of <br />fill in wetlands in violation of state or federal regulations. Applicants must submit evidence <br />to the Planning Commission that, if wetlands are present on the site, the North Dakota Fish <br />and Wildlife Service, the U.S. Fish and Wildlife and/or U.S. Army Corps of Engineers have <br />been contacted to determine the ability of state and federal wetland regulations. Any <br />approval of the Planning Commission shall be contingent on full compliance with any <br />requirements of any regulatory agency and no action by the Planning Commission shall be <br />relied on in lieu of a permit issued by the appropriate agency. <br />Section 6.08 Landscaping and Additional Vegetation Requirements <br />(a) Landscaping. <br />1. Vegetative buffer planting shall be provided around the perimeter of commercial or <br />industrial properties adjacent to residentially zoned property or existing residential <br />development. Vegetative buffer planting shall also be provided in major subdivisions for all <br />areas adjacent to land used for the production of crops (including CRP and idle land) or <br />livestock, existing commercial or industrial developments without buffer plantings, or lots <br />with frontage or reverse frontage along a section line road. The design of the buffer planting <br />shall be consistent with the North Dakota NRCS Design and Installation Guide: <br />Windbreak/Shelterbelt Establishment-380 and the following requirements and shall be <br />outlined in a site specific plan presented to the Planning Commission: <br />a. Parking and buildings are prohibited within the buffer area. <br />b. Buffer areas shall consist of a minimum of three (3) rows including one (1) row of <br />medium to tall trees.
