Planning Commission Minutes – May 26, 2022 2 <br /> <br />2. Hearing on an application requesting a Major Subdivision Plat of TEPI Third Subdivision located <br />in Section 33, Township 140 North, Range 52 West of the 5th Principal Meridian, Casselton <br />Township, Cass County North Dakota. <br />Mr. Lougheed opened the public hearing. <br /> <br />Ms. Puppe provided an overview of an applicant seeking approval of a minor subdivision entitled <br />TEPI Third Subdivision to plat a seven (7) Lot subdivision of approximately 498.15 acres. According <br />to the applicant, the plat of TEPI Third Subdivision was approved by the City of Casselton, North <br />Dakota and recorded in the Cass County, North Dakota Recorder’s Office on December 19, 2013, <br />as Document No. 1407712. <br /> <br />A consent and joinder by Cass County is required because a portion of such plat lies within the <br />City of Casselton’s ETJ (shared jurisdiction with Cass County) and the other portion of such plat <br />lies outside of the ETJ. This application is being made to cure the jurisdictional defect of such plat <br />by retroactively obtaining Cass County’s consent to and approval thereof. <br /> <br />The proposed ownership and maintenance responsibility of the subdivision will be private. The <br />subdivision will use an existing 153rd Ave SE (County Road 23) road access, ditches and storm <br />sewer system for storm sewer conveyance, rural water, and on-site septic systems for wastewater <br />treatment. <br /> <br />Dan Buede explained that the plat was previously platted through the City of Casselton and the <br />County was not included as an oversight of the ETJ area. The idea of a consent and joinder came <br />about to correct this and include the County in the approval of this plat. There has been <br />preliminary discussion with the City of Casselton about annexing the property or coming up with <br />an agreement to control zoning/subdivision with the township and County. <br /> <br />Mr. Benson went over the access to the county road and addressed traffic concerns for this <br />property. The current property has paved roads, stormwater pond, lighting and access to internal <br />lots. <br />MOTION, passed <br />Dr. Mahoney moved and Commissioner Scherling seconded to accept the findings and <br />recommend approval to the County Commission with any conditions outlined by the <br />County Planner. <br />On a roll call vote with all in favor, motion carried. <br /> <br />3. Hearing on an application requesting a Major Subdivision Plat of TEPI Fourth Subdivision located <br />in Section 33, Township 140 North, Range 52 West of the 5th Principal Meridian, Casselton <br />Township, Cass County North Dakota. <br />Mr. Lougheed opened the public hearing. <br /> <br />Ms. Puppe provided an overview of an applicant seeking approval of a minor subdivision entitled <br />TEPI Fourth Subdivision to plat a five (5) Lot subdivision of approximately 285.51 acres. According <br />to the applicant, the plat of TEPI Fourth Subdivision is a replat of Lot 1, Block 1, TEPI Third <br />Subdivision, splitting such lot into 5 lots. <br /> <br />The proposed ownership and maintenance responsibility of the subdivision will be private.
