May 19, 2022 <br />12 <br /> <br />Section 2.07 Procedures for the Review and Consideration of Plat Applications <br />(a) Procedures for the Review and Consideration of Plat Applications in accordance with this <br />Ordinance are described in Articles IV, V, and VI. <br />Section 2.08 Public Hearings Procedure <br />(a) Public Hearings required by this Ordinance shall be conducted pursuant to the standards <br />and procedures of this Section. <br />(b) Notice <br />Unless state law requires differently, written notice of the public hearing, pursuant to Section <br />5.10 Public Notice, shall be sent by mail to the owner of the property that is subject to the public <br />hearing and to owners of land that is with property within 5,280 feet of the property that is <br />subject to the public hearing. In addition to the mailed notice, a Public Notice of the hearing that <br />describes the application and provides the time, date and place of the public hearing shall be <br />published in the official county newspaper and any newspaper of general circulation in the <br />county at the discretion of the County Planner or the body holding the hearing. The Public <br />Notices shall be mailed, and the published notice shall appear in each newspaper once a week <br />for two successive weeks prior to the date of the hearing. <br />(c) Announcement <br />The presiding officer shall announce the purpose and subject of the public hearing, verify that <br />proper public notice was given and provide the opportunity for any member of the Commission <br />or Board to declare a conflict of interest. <br />(d) Right to Speak <br />Any interested person may appear at the public hearing and submit evidence or make <br />comments either as an individual or on behalf of an organization. Each person appearing at the <br />public hearing shall be identified by name and address of residence and name of organization if <br />applicable. <br />(e) Staff Report Presentation <br />The County Planner shall present a report that provides a detailed overview of the application <br />and requested decision, its site, context and its compliance with the comprehensive plan and <br />this ordinance. <br />(f) Applicant Presentation <br />The applicant shall present any information the applicant deems appropriate. <br />(g) Public Comments <br />Members of the public shall be provided the opportunity to speak about the merits or <br />shortcomings of the application. At the discretion of the presiding officer, reasonable time limits <br />may be placed on all speakers in the interest of accommodating all people desiring to speak and <br />to provide for an efficient meeting. Comments shall be directed only to the presiding officer. <br />(h) Applicant Response <br />After the members of the public have given their comments, the applicant shall be provided the <br />opportunity to respond to any public comments made during the public hearing.
