<br />Commission Minutes-June 18, 2007 3214 <br /> <br />over the Red River; <br />Holth Sand & Gravel Company-gravel supply for the northwest <br />corner of the county; <br />Titan Machinery-amended rental agreement for New Holland <br />tractors; <br />North Dakota Department of Corrections-intergovernmental <br />service agreement for boarding of parole violators in the amount of <br />$60 per day. <br /> <br />6. COUNTY BUILDING COMMITTEE, Judae Doua Herman appointed <br />Mr. Wagner is chairman of the building committee and provided some background on <br />this item. In 2003, presiding Judge Norman Backes appointed Judge Wade Webb to <br />serve as the court representative on the committee. The appointment was approved <br />by the board on December 15, 2003. Last month current presiding Judge Georgia <br />Dawson submitted a letter requesting Judge Webb be replaced on the committee. An <br />issue arose after a question was asked at the last building committee meeting <br />regarding Judge Webb being chambered in Traill County. Bonnie Johnson, County <br />Administrator, said she asked the question to determine space availability in other <br />areas of the regional court system outside Cass County. Mr. Wagner felt the <br />question was taken out of context and said Judge Webb spends the majority of his <br />time presiding over cases within the Cass County Courthouse and has knowledge of <br />the court system. <br /> <br />Judge Georgia Dawson was present. She said Judge Webb resigned from the <br />committee after a unanimous decision of the judges for Judge Doug Herman to serve <br />as the court representative. She said judges in the East Central Judicial District are <br />being assigned to specialized areas and Judge Herman served this year as the <br />legislative liaison. <br /> <br />Mr. Vanyo also serves on the building committee and said Judge Webb has served <br />the courts well and has a history on the committee. He questioned the reason to <br />replace him at this time. Judge Dawson said the replacement is not based on Judge <br />Webb's performance as he has performed ably. <br /> <br />Mr. Wagner feels a court representative on the committee is needed; however, he <br />stressed the judiciary not only serves on the committee from a position of advocacy <br />but also one of compromise. Judge Dawson said the court's space needs are not <br />superior to any other department's space needs and she knows the importance of the <br />planning process for a new building addition. <br /> <br />Mr. Bennett said Judge Webb respectfully resigned and feels the commission needs <br />to honor his wishes. <br />MOTION, passed <br />Mr. Bennett moved and Mr. Pawluk seconded to replace Judge Wade <br />Webb and appoint Judge Doug Herman to the Cass County Building <br />Committee. On roll call vote, the motion carried with Mrs. Sorum, Mr. <br />Bennett and Mr. Pawluk voting "Yes" and Mr. Wagner and Mr. Vanyo <br />voting "No". <br />
