To refresh your <br />memory, my clients, Peter and Katrina Doll, purchased some land that had been owned <br />by HUD from Cass County at a tax forfeit sale several years ago. They were the <br />successful bidder at the sale, and paid the County $8,000.00. In turn, they received a <br />deed for the property from Cass County. <br /> <br />When the Dolls went to get financing on this land, they discovered that there was <br />an issue with respect to HUD's previous ownership of this land. As a result, it was <br />necessary to obtain a deed from HUD. When HUD looked into this matter, they <br />questioned whether Cass County had authority to conduct a tax forfeit sale on this land <br />that was owned by HUD. In order to avoid a court fight, the parties verbally agreed that <br />Cass County would refund $4,000.00 of the purchase price and that amount would be <br />paid to HUD. <br /> <br />Because of the amount of time it was taking to get this iesolved, the Dolls <br />decided to pay the $4,000.00 directly to HUD and wait for reimbursement from the <br />County. Enclosed with this letter is a copy of the $4,000.00 check that was tendered to <br />HUD, as well as a copy of the recorded Quit Claim Deed signed by HUD re-conveying <br />this property to the Dolls. <br /> <br />As a result of these monies paid to HUD, the Dolls are now looking to the County <br />to get reimbursed. I would appreciate it if you would place this on the consent agenda <br />for the next available County Commission meeting, so that we can get this resolved. <br />Since the title is now clear, the only thing we would be looking for is the reimbursement <br />from Cass County. <br /> <br />ANDERSON, BOTTRELL, SANDEN, THOMPSON, HULL, HAUFF, CARLSON & DONARSKI, P.c. <br />
