The one <br />remaining issue is a release from any further claims <br />concerning this sale. In my opinion, a release is <br />essential as part of this deal and Birch Burdick is <br />working on a document for Mr. Doll to sign. <br /> <br />This settlement involves tax forfeited property that we <br />sold to Mr. Doll in the normal course of processing <br />delinquent taxes. In this case, we had served HUD by <br />certified mail and had made telephone contact with them, <br />but apparently were not able to get their attention <br />enough to pay the tax bill. Once Mr. Doll tried to quiet <br />title the property, HUD raised an objection. <br /> <br />The County sold the property for $8,000, which was a <br />little over $7,000 more than the outstanding taxes. We <br />will be returning $4,000 to Mr. Doll to compensate him <br />for the money he paid to HUD for a Quit Claim Deed. <br />HUD's claim is that a local unit of government can not <br />take property for non-payment of taxes by their agency. <br /> <br />The only area of the budget for this type of expense <br />would be the Contingency Line Item in the Commission <br />Budget which has $6,000 uncommitted for 2007. <br /> <br />Sincerely, <br /> <br /> <br />~.A<:L/7!1-f~~ <br /> <br />Michael Montplaisir <br />County Auditor <br /> <br />SUGGESTED MOTION: <br /> <br />Move to authorize the payment of $4,000 as a settlement <br />to Peter Doll on the sale of land in Section 26 of Howes <br />Township as a result of a tax forfeiture auction upon <br />receipt of a release from any further liability. <br />
