<br />COURT SERj'ICES AGREEME~]~ <br /> <br />2 This Agreement is between the State of:\orth Dakota, by and through the East <br />3 Central Judicial District ("Court"), and Cass County, NOlih Dakota ("County''). This <br />4 Agreement is effective on the date of the last signature. <br /> <br />5 SECTION I <br /> <br />6 WHEREAS, the County has a home rule charter, has enacted certain ordinances <br />7 under that charter, and may from time-to-time enact additional ordinances; and <br /> <br />8 WHEREAS, the Court has jurisdiction under N.D.C.C. Section 27-05-06(6) to <br />9 hear and determine actions and proceedings concerning the enforcement of county home <br />10 rule charter ordinances; and <br /> <br />11 WHEREAS, the County does not have a separate court within which to hear cases <br />12 arising under its home rule charter ordinances; <br /> <br />13 NOW THEREFORE, the Court and the County agree as follows; <br /> <br />14 <br /> <br />15 <br /> <br />16 <br /> <br />17 <br /> <br />18 <br />19 <br />20 <br /> <br />21 <br /> <br />22 <br /> <br />7'" <br />__, <br /> <br />1. <br /> <br />Cases covered by this Agreement include those that may arise through <br />violations of County ordinances. <br /> <br />2. <br /> <br />The County shall provide the prosecuting attorney and pay all prosecution <br />costs and expenses f()r all cases covered under this Agreement. <br /> <br />'" <br />-) . <br /> <br />The County shall pay all indigent defense costs and expenses for all cases <br />covered under this Agreement.
