· County will pay for any transcripts that may be required.
· The Court will get 60%, and the County 40%, of any
amounts collected. (This is the same % I have seen in the
contracts I have viewed from other jurisdictions.)

The scope of the financial implications is dependent upon the how many
ordinances we enact, how many cases arise under those ordinances, how
many defendants may desire or qualify for a public defender and how
many, if any, may require preparation of transcripts. Given that the
penalties related to the ordinances are somewhat limited in scope, I would
guess the "public defender" aspect would be limited.

I have modified the terms proposed by the Court in the manner shown in
handwriting and Enclosure A. While I would normally work to obtain final
wording with both sides prior to submitting this to the Commission, after
discussion with the Court I recommend the Commission consider
approving the enclosed Agreement (as modified) and having me submit
this approach to the District Court/State Court Administrator for final
consideration.

Enclosure: Court Services Agreement (hand-marked), and
Enclosure A to Agreement

Proposed Motion: Approve a Court Services Agreement, as modified
in the enclosure.

cc: Don Rudnick, Cass County Sheriff (w/encl.)
Keith Berndt, Cass County Engineer (w/encl.)
Mike Montplaisir, Cass County Auditor (w/encl.)
Presiding Judge, East Central Judicial District (w/encl.)
