<br />COURT SERVICES AGREEMENT <br />This Agreement is between the State of North Dakota, by and through the East <br />Central Judicial District (hereafter "Court"), and Cass County, North Dakota (hereafter <br />"County"). The Agreement shall be effective on the date of the last signature. <br />SECTION I <br />WHEREAS, the County has a home rule charter, has enacted certain ordinances <br />under that charter, and may from time-to-time enact additional ordinances; and <br />WHEREAS, the Court has jurisdiction under N.D.C.C. S27-05-06(6) to hear and <br />determine actions and proceedings concerning the enforcement of county home rule <br />charter ordinances; and <br />WHEREAS, the County does not have a separate court within which to hear <br />cases arising under its home rule charter ordinances; <br />NOW, THEREFORE, the Court and the County agree as follows: <br />1 . Cases covered by this Agreement include those which may arise <br />through violations of County ordinances. <br />2. The County shall provide the prosecuting attorney and pay all <br />prosecution costs and expenses for all cases covered under this Agreement. <br />3. INTENTIONALLY LEFT BLANK. <br />4. The County shall pay any required transcript costs for all cases covered <br />under this Agreement, unless the transcript is requested by a defendant who was or is <br />represented by privately-retained counsel at trial or post-trial proceedings. <br /> <br />Page 1 of 3 <br />
