<br />CHAPTER 6 <br /> <br />Subdivision Plats <br /> <br />6.1 Subdivision Plats <br /> <br />When property abutting a county highway is to be subdivided or developed, direct access to a <br />county highway shall not be used in lieu of an adequate internal traffic circulation system and any <br />direct access to a county highway shall meet the Cass County Highway Access Ordinance and <br />be approved by the County Engineer. <br /> <br />6.2 Direct Access <br /> <br />Direct access either to or from the county highway shall be restricted and shown on the plat with <br />a negative access easement. <br /> <br />6.3 Negative Access Easement <br /> <br />The negative access easement shall be depicted on the plat with a legible hatched area of <br />appropriate width and shall include the following language on the plat: <br /> <br />Negative Access Easement, as noted on this plat, is an easement dedicated as part of the right- <br />of-way dedication which easement denies direct vehicular access to a street or public way from <br />the lot or lots adjacent to such street or way. The negative access easement is not a strip of land <br />of any certain width, but is a line coterminous with the boundary of the adjacent lot or lots. <br /> <br />CHAPTER 7 <br /> <br />Requirements for Permanent Access Facilities <br /> <br />7.1 Permit Process and Requirements <br /> <br />The process for a Permanent Access Permit consists of the following steps: <br />1. The applicant shall sign and submit an application. <br /> <br />2. The Highway Department will verify the access location in the field and determine if the <br />location will provide safe ingress and egress to the lot. At this time the determination of <br />the need for such items as culverts will be made. <br /> <br />3. The County Engineer may require other additional studies, plans, and information in <br />order to review and evaluate the applicant's application.
