<&-lj1 ccw The Client also agrees that unauthorized copying and distribution of the Software and/or documentation is a violation of the license conditions and rights ofCCW and will cause great damage to CCW, and that this damage is far greater than the value of the copies involved. Limitation of Liability In no event will CCW corporation nor anyone else involved in the creation, production or delivery of the software be liable for any damages, including loss of data, lost profits, cost of cover or other special, incidental, consequential or indirect damages arising from the use of the program, however caused, and on any theory ofliability, This limitation will apply even if CCW has been advised of the possibility of such damages. This agreement is subject to the laws of Wisconsin, however, ifany of the provisions, or portions thereof, of this agreement are invalid under any applicable statute or rule of law, they are, to that extent, to be deemed to be omitted. Term The license shall be effective from: date of installation and shall be perpetual. CCW may terminate the license if the Client commits a material hreachofthis agreement, which the Client fails to remedy despite being given twenty (20) days notice to remedy. In this case, CCW may only terminate by written notice and upon termination the Client will be obliged to return to CCW, all software together with all copies, modifications and documentation. Limited Warranty CCW warrants that the licensed software will operate as represented by CCW and is of merchantable standard for its purpose. CCW's liability will be limited to replacement of the software program. Except as noted, the software is licensed, not sold, on an "as is" basis. CCW makes no expresses or implied warranties with regard to errors or misuse of this software. Use of Other Software CCW does not limit the Client in any way from using other software from any source on any and all machines, The Client assumes all responsibility for any failure due to such mix of programs not licensed by CCW, This license is specific to Cass County Sherin' Department of Corrections, and shall not apply to any other license agreement issued by CCW, Inc. Taxes, Custom Duties The Client agrees to pay all taxes and/or duties arising from or based on the license fee.
