RESOLUTION #2007-1, MIDA Bond Application for Hospice of the Red River Valley <br />Proiect <br />Attorney James Stewart was present to answer questions concerning the application of the <br />Hospice of the Red River Valley Project for MIDA Bond financing in an amount not to <br />exceed $2,600,000 for the purpose of financing the acquisition of an office building located <br />at 1701 38th Street South in Fargo. Mr. Stewart said a public hearing is scheduled for <br />February 5, 2007. <br />MOTION, passed <br />Mr. Bennett moved and Mrs. Sorum seconded to adopt Resolution #2007- <br />1, Relating to a Project under the Municipal Industrial Development Act, <br />Giving the Project Preliminary Approval, Subject to a Public Hearing <br />(Hospice of the Red River Valley Project). On roll call vote, the motion <br />carried unanimously. <br /> <br />8. RESOLUTION #2007-2, Condemnation of right of way for County Road 16 <br />improvements <br />County Engineer Keith Berndt said the 2007 road projects include completion of ditch slope <br />improvements to two miles of County Highway 16 west of Davenport. The county has <br />successfully negotiated the purchase of several parcels necessary to accommodate the <br />road widening; however, one parcel of land owned by Leland Hans has not been <br />negotiated. <br /> <br />The county currently has a 40 foot easement from the center of the road that includes the <br />statutory 33 feet and an additional 7 feet acquired in 1937. The project requires an <br />additional 40 feet for a total of 80 feet. Mr. Hans does not object to the per acre price <br />offered for the 40 feet, but feels he should be compensated for the 7 foot easement <br />previously acquired. Mr. Berndt said the parcel in dispute amounts to .42 acres so the dollar <br />value is very small, but the precedent for paying for land that was previously acquired is <br />significant and therefore, he recommends condemning the property. <br />
