CASSC'tJUNIT
(, , ) V ERN \1 F ~~ T

..I.-

--- TO:

MEMO

FROM:

Cass County Commission
Bonnie Johnson ~

County
Coordinator

DATE:

December 7, 2006

H( \!ll1iel, II tn,. In

SUBJECT:

JAIL CHANGE ORDER

----------------------------------------------------------------

In August 2006, I became aware of a construction problem connecting the new jail
addition to the existing building. A steel lintel had been overlooked in the plan and a
"hold open" for conduit had not been designated by the architects in the original
building, requiring additional work on the second phase of the project. Byemail (see
attached document), I sent an inquiry to Foss Architecture about the proposed
change order and why this connection point had not been anticipated in the original
design.

The Foss construction manager responded by saying there was "miscommunication
between Kathy (the mechanical engineer) and Rochelle (from Foss Architecture)."

Anticipating a change order, I asked Rick Hoganson of Foss to meet with Birch
Burdick and me about this issue. No consensus was reached between the county
and Foss Architecture.

The change order, dated September 26, 2006, for a total cost of $7,585.00 was
received in my office earlier this month and because the costs exceed $5,000, I have
scheduled the item on the Board's agenda for discussion.

I have asked Rick Hoganson to be present at the commission meeting to discuss
this item.

SUGGESTED MOTION:
Move to approve the change order in the amount of $7,585.00 as presented by Foss
Architecture.

OR

SUGGESTED MOTION:
Move to approve the change order in the amount of $7,585.00 as presented by Foss
Architecture, with the stipulation that their contractual fee of 5.5% would not be
charged on this change order.

OR

SUGGESTED MOTION:
Move to not approve the change order payment of $7,585.00 because Cass
County Government is not responsible for the errors and omissions of the
Ih, 2Sl)(1 architect.

211 Ninth Stn.'\'t ;-'\luth
Farl!o, '\Jorth PaLlta 'iKl,\'i
~ cnc

1,1! .241.'i7 2,) K:\BJ\JAIL ADDN 12-7-06 MEMO.doc
rax: 7l'J .':'J7 -(lC":C
