As part of the project, the riverbank will be graded, deep-rooted <br />vegetation planted and their on-site septic drain fields will be relocated to their <br />side yard. The Red River Regional Council will cost share 60% of the riverbank <br />restoration project (excluding drain field relocation) and because of the large <br />financial support they are asking the homeowners to sign a Land Use Agreement <br />and Easement with Cass County to limit any future activities that would be <br />detrimental to the projects success. This contract would prevent landowners <br />from changing the vegetation, irrigating their back yards, installing a drainfield <br />in their back yard, adding new fill, constructing new structurest etc. <br /> <br />The law firm of Ohnstadrrwitchell has reviewed and revised this document. <br /> <br />SUGGESTED MOTION: AUTHORIZE CHAIRMAN TO SIGN LAND USE <br />AGREEMENT AND EASEMENT WITH THE SIX HOMEOWNERS <br />P ARTICIAPTING IN THE KENSINGTON PLACE RIVERBANK ST ABILZIA TON <br />PROJECT NO. 2005-1 UPON RECEIPT AND SUBJECT TO THE STATES <br />ATTORNEY'S APROVAL. <br /> <br />J"A()M1N.EN(~\n)MM1SSI0N CORRSP\2006\CONTRAcr APPROVAL KENSINGTC1N PLACP.
