MEMORANDUM

TO:

Commission

FROM:

Birch P. Burdick
Cass County State's Attorney

DATE:

September 11, 2006

RE:

Comments on SRF Proposal, dated September 6, 2006

*****.*.*.*.****..***

I offer the following comments:

. Page 2, at bottom: it indicates the sub-consultants costs are "estimates", and
may be adjusted up or down based upon actual costs. This would seem to
be rather uncertain. Those costs were not included in my copy, and perhaps
are relatively incidental.

. Page 3, at top: it indicates the County will be responsible for all project bid
opening costs, including, among others, "legal fees". I am not aware of any
legal fees likely to arise. If they are planning on incurring legal fees, then we
should know what those are and for what purpose.

. Page 3, near bottom: it indicates a project cost, and then says that any
additional services that may be requested "will be billed on the same time
and expense basis". However, it does not, at least in my copy, outline what
basis that is. If they simply mean a time-and-materials basis, that explains
the methodology, but does not mention at what hourly rate their "time" may
be (at least in my copy).

The comments above should not prohibit the Commission from authorizing the proposal.
However, they are my suggestions for clarifications. Otherwise it is approved as to form.
