JOINT POWERS AGREEMENT FOR PURCHASING <br /> RESOLUTION OF ACKNOWLE 3GMENT <br /> <br /> WHEREAS vadous counties of North Dakota have entere¢ into a Joint Powers Agreement for the <br />centralized and coordinated acquisition and delivery of essential and optional services by participating <br />member counties (hereafter referred to as the "Master JPA"); <br /> <br /> AND WHEREAS, the undersigned county ("County") is a participating member of such Master JPA; <br /> <br /> AND WHEREAS, the North Dakota Association of Cou3ties (NDACo), has secured the joint <br />acquisition of the service described below on behalf of those participating members of such Master JPA; <br /> <br /> AND WHEREAS, the County has determined that the joint ~ cquisition of this specific service is in its <br />best interests; , <br /> <br />SERVICE PURCHASED: Sl3ecial Ol~erations Team S~l~130rt <br /> NOW THEREFORE, it is hereby RESOLVED: I <br /> <br /> 1. That the County recognizes the potential need for the services of a qualified law <br /> enforcement Special Operations tactical team by those various law enforcement agencies of <br /> the County that don't maintain such a unit themselves. <br /> 2. That it is not cost effective for every county and city to maintain such a team; however isn't <br /> possible for those entities that maintain such teams to provide no-cost access to their teams <br /> when needed by other entities. <br /> 3. That the North Dakota Bureau of Criminal Investigation (BCI) encourages the use of <br /> <br />o <br /> <br />o <br /> <br />qualified Special Operations teams in appropriate s'tuations and has indicated it's intention <br />to support this joint effort by serving as depository cf funds and fiscal agent for payments to <br />agencies providing Special Operations team support to all law enforcement agencies within <br />participating counties. <br />That the County agrees to make annual paymerts into a Special Operations Fund to <br />facilitate no-cost access to the Special Operations Team offering services to the law <br />enforcement agencies of the County, when requested by those agencies and when the <br />situation meets established criteria as determined by the North Dakota Attorney General <br />pursuant to NDCC 54-12. <br />That the County agrees to make the annual payment established by Attachment 1 to <br />NDACo, on or before January 31~ of 2004 and each year thereafter. That should the annual <br />payment need to be increased to meet the actual and anticipated reimbursements for <br />Special Operations Team support, NDACo will notify the County in writing by August 31~of <br />the preceding year. <br />That the County may rescind this acknowledgment without terminating the Master JPA, by <br />notifying BCI in writing prior to October l't of the yea' preceding termination. <br />That the County accepts that if it terminates this acknowledgement, the full costs of <br />accessing a qualified Special Operations team can be billed directly to the County by the law <br />enforcement entity maintaining the Special Operatior s team. <br />That NDACo shall notify the County in writing, and he County's participation in this service <br />will be terminated, at such time as there is no qualified Special Operations Team available to <br />serve the County. <br /> <br /> day of October, 2003 ~ <br /> CASS COUNTY <br /> (The "County' herein) <br /> <br /> By: <br /> Scott Wagner <br /> Chair - Board of County Commissioner <br /> <br />Dated this 20 <br /> <br />Attest: <br /> <br />Michael Montplaisir, County Auditor <br /> <br /> <br />
