<br />June 5, 2006 <br /> <br />VIII. Maintenance of Records. <br /> <br />A. Fiscal Records. The Host Region will maintain sufficient documentation <br />to substantiate the actual costs of the Unit, separate and distinct from the <br />costs of the Grand Forks Regional Child Support Enforcement Unit, in a <br />format compatible with the needs of the State. The documentation will be <br />available for inspection by the parties to this Agreement, the Secretary of <br />the United States Department of Health and Human Services, or any <br />person authorized by a party or the Secretary. The procedures for cost <br />reporting and billing to the State will be determined by mutual agreement <br />between the State and the Host Region. <br /> <br />B. Case Records. All records obtained or created by the Unit shall be filed <br />in a case file maintained by the Host Region and documented on the <br />State's automated system. <br /> <br />C. Record Retention. The Host Region will retain all fiscal records and case <br />records for as long as required under federal and state laws and <br />regulations. <br /> <br />D. Safeguarding. The Host Region will maintain the confidentiality of all <br />information concerning recipients of child support enforcement services <br />and will use the information only for purposes directly connected with <br />administration of the child support enforcement program under North <br />Dakota Century Code section 50-06-15, or as otherwise permitted by state <br />and federal law. <br /> <br />IX. Assignment. None of the parties may assign this Agreement without the written <br />approval of the other parties, which shall not be unreasonably withheld. Any <br />assignee must agree to honor this Agreement. <br /> <br />X. Integration and Modification. This document, including Attachment A and the <br />Host Region's proposal dated December 21 , 2005, is the entire agreement <br />between the parties with regard to the operation of the Unit. No change to this <br />Agreement shall be effective unless it is reduced to writing, signed by the parties <br />and attached to this Agreement. <br /> <br />XI. Authority to Enter Agreement. By signing this Agreement, each individual is <br />certifying that the individual has authority to bind the Participating Region and the <br />counties within that region to the terms of this Agreement. <br /> <br />XII. Personnel. The Host Region plans to hire five staff members for the Unit. The <br />budget in Attachment A includes an increase in funds for salaries from the <br />budget in the Host Region's proposal dated December 21, 2005. The purpose of <br />the increase is to provide sufficient funds for the Host Region to hire one of the <br />five staff members as a lead worker and for two of the other staff members to <br /> <br />4 <br />
