<br />June 5, 2006 <br /> <br />STATE OF NORTH DAKOTA <br />DEPARTMENT OF HUMAN SERVICES <br />CHILD SUPPORT ENFORCEMENT <br /> <br />INTERAGENCY COOPERATIVE AGREEMENT <br /> <br />I. Parties. This interagency cooperative agreement (Agreement) is entered into <br />between the Department of Human Services through its Child Support <br />Enforcement Division (State), the Grand Forks Regional Child Support <br />Enforcement Unit (Host Region), the fifty-three county social service boards, and <br />the eight regional child support enforcement units (Participating Regions) in <br />North Dakota, pursuant to a directive of the State under North Dakota Century <br />Code section 50-09-34. <br /> <br />II. Purpose. The purpose of this Agreement is to provide for operation and <br />administration of a centralized outgoing interstate unit (Unit) by the Host Region <br />on behalf of the State and the Participating Regions under North Dakota Century <br />Code Sections 50-09-03(5), 50-09-33 and 50-09-34, as further described in the <br />Host Region's proposal dated December 21, 2005, which is incorporated by <br />reference into this Agreement. <br /> <br />III. Term of Agreement. This Agreement commences when all necessary <br />signatures have been obtained and remains in effect through December 31, <br />2007. Upon written agreement of all parties no later than October 15 of each <br />year, the agreement may be extended on the same terms (subject to any budget <br />changes and revisions to Attachment A) for additional one-year periods. The <br />Agreement, including any extension of the Agreement, may be terminated only <br />by unanimous consent of the parties, upon a change in the legal authority for the <br />Agreement, or if appropriations by the Legislative Assembly are not obtained and <br />continued at a level sufficient to allow for payments to the Host Region under this <br />Agreement. A county may withdraw from this Agreement if appropriations are <br />not obtained and continued by the county at a level sufficient to allow for <br />payments to the Host Region under this Agreement. <br /> <br />IV. Duties, Functions, and Responsibilities of the Parties <br /> <br />A. All Parties. The parties to this Agreement commit to working in good faith <br />to support the success of the Unit. The parties will work cooperatively to <br />study and explore methods to improve delivery of support enforcement <br />services and to reduce costs to participants and taxpayers. <br /> <br />B. Host Region. The Host Region agrees to: <br /> <br />.
