<br />RESOLUTION #2006- <br />ADOPTING EXCISE TAX FOR EMERGENCY SERVICE COMMUNIC,AinONS <br />SYSTEM E-911 I <br /> <br />WHEREAS, The North Dakota State Legislature in Chapter 57-40,6 of the North Dakota <br />Century Code has a process by which counties can generate income through ani excise tax on <br />the use of telephone access lines and wireless service in order to finance an emergency 911 <br />telephone system; and I <br /> <br />WHEREAS, The citizens of Cass County voted to implement an emerge~cy 911 <br />telephone system in 1988 and to levy a $.50 per access line; and I <br /> <br />WHEREAS, The citizens of Cass County voted to continue the emergendy 911 <br />telephone system In 2000 and increase the levy to $1.00 per access line; and I <br />I <br />WHEREAS, The Board of County Commissioners of Cass County extended the <br />emergency 911 telephone levy to wireless service in 2001 as allowed by Chapte1r 57-40.6 of the <br />North Dakota Century code to finance upgrades to the infrastructure necessary /0 provide <br />wireless enhanced 911 service; and I <br /> <br />WHEREAS, The Board of County Commissioners of Cass County deeml it to be a <br />health and safety benefit for the county to continue to have an emergency 911 telephone <br />system; and i <br /> <br />WHEREAS, The Board of County Commissioners of Cass County are fabing increased <br />, <br />costs for operation of the emergency 911 telephone system; and I <br /> <br />WHEREAS, The North Dakota State Legislature in Chapter 57-40.6 of thk North Dakota <br />Century Code requires the continuation of the excise tax to be accomplished by 'a vote of the <br />citizens of Cass County; i <br />, <br />NOW, THEREFORE, BE IT RESOLVED by the Board of County Commihioners, of <br />Cass County, North Dakota, as follows: i <br /> <br />1. That the County of Cass continue with the emergency 911 telePh~ne system <br />established in 1988 and extended to wireless service in 2001 for the safety of the <br />citizens of Cass County. i <br />, <br />I <br />That the following issue be placed on a ballot at the June 13, 2006 primary <br />election in the County of Cass for those geographical areas withi~ Cass County <br />where other political subdivision have not already imposed such ~n excise tax: <br /> <br />Shall the County of Cass continue the excise tax for emeJgency 911 <br />telephone service and wireless service for a period of six years beginning <br />December 1, 2006, at the statutory limit of $1.00 per month per telephone <br />access line and per wireless service for the operation of an emergency <br />911 telephone system for the County of Cass? ) <br />, <br />I <br />I <br />I <br />i <br />, <br />i <br /> <br />2. <br /> <br />I_I <br />I_I <br /> <br />Yes <br /> <br />No <br /> <br />, <br />I <br />I <br />3. That the excise tax shall be at a rate of $1.00 per month per telephone access <br />line and per each wireless service; however, the Board of County Commissioners <br />of Cass County may reduce the excise tax by subsequent resolution if sufficient <br />funds are received to operate and maintain the system.
