<br />Contractor shall provide a certificate of insurance at time of execution of contract <br />and at anniversary date of execution of contract, showing Cass County Weed <br />Board as the certificate holder (proof of insurance). <br />The contractor shall indemnify, save, and hold harmless the county and <br />employees thereof, from any and all claims, demands, actions or causes of <br />action arising out of the negligent acts, errors, or omissions of the contractor, <br />his/her employees, or agent in the performance of the agreement, or matters <br />incidental thereto. <br />Any and all persons employed directly or indirectly by the contractor who <br />are engaged in the performance of any work or services required by the <br />contractor under this agreement shall be considered employees of the contractor <br />and not the county. <br />The contractor shall comply with all federal, state, and local laws together <br />with all ordinances and regulations applicable to the work. He/she shall procure <br />all licenses, permits, and other rights necessary for the fulfillment of his/her <br />obligations under this agreement. <br /> <br />6. L1CENSEfTRAINING. Contractor shall ensure that all of the spray <br />appiicators qualify for and obtain the AG PEST and RIGHT-OF-WAY applicators <br />certificate/license for North Dakota. Applicators are to be thoroughly trained by <br />the CONTRACTOR in spraying the noxious weeds designated for spraying <br />before going out on the 1st job - and understand the purposes & limitations of <br />each herbicide to be used. The Contractor shall be specifically diligent in seeing <br />that the spray applicator sprays each plant with a mist and seeing that an area of <br />at least 10 feet adjacent to the mature plants be sprayed - so as to catch <br />possible seedlings. <br /> <br />7. RECORDS. Contractor and/or sprayer operator shall complete daily spray <br />reports (NDDA SFN 50020 (3-96) or similar), NDDOT SFN 17825 (Rev. 05- <br />2000), maps of spray activity, and other requisite spray forms accurately and <br />shall supply copies to the Weed Officer. <br /> <br />8. CHEMICALS. The Contractor shall provide all chemicals, adjuvants, <br />conditioners and water used for right of way spraying. Contractor shall use such <br />herbicides, mixtures and rates of application at or below recommended label <br />rates. as recommended by the Cass County Weed Officer. The Contractor shall <br />advise the Weed Officer twice a week of the general location where spraying <br />activities will be undertaken and of any inappropriate spraying conditions. <br /> <br />9. MISCELLANEOUS. If the Weed Officer or a Weed Board Member <br />determines that a thorough job of spraying was not accomplished, Contractor will <br />return and respray the area at no expense to the Board. <br /> <br />3 <br />
