SECTION IV. Contractor shall provide all chemicals and shall be responsible for any and all licenses, pennits, fees, and all other items required of aerial applicators of pesticides. The chemical usage rates will be detennined by Cass County Vector Control and shall be subject to Section III of this Agreement. SECTION V. All chemicals used by Contractor must be a chemical which has been previously approved by the Environmental Protection Agency, the North Dakota State Department of Health and the Cass County Public Health Department prior to application. Further, all chemicals must be applied according to the manufacturers' label, terms and specifications. SECTION VI. Contractor shall comply with all applicable statutes, ordinances, rules, regulations, and orders of all public agencies and authorities relating to the aerial application of pesticides over residential areas, SECTION VII. No waiver or modification of this Agreement or of any covenant, condition or limitation herein contained shall be valid unless in writing and duly executed by the party to be charged therewith and no evidence of any proceeding, arbitration, or litigation between the parties hereto arising out of or affecting this Agreement, or the rights or obligations of the parties hereunder, unless such waiver or modification is in writing, duly executed as aforesaid and the parties further agree that the provisions of this section may not be waived as herein set forth. SECTION VIII. Contractor will immediately secure public liability insurance in the minimum amounts as follows: .
