<br />SECTION IV. <br />Contractor shall provide all chemicals and shall be responsible for any and all licenses, pennits, fees, <br />and all other items required of aerial applicators of pesticides. The chemical usage rates will be detennined <br />by Cass County Vector Control and shall be subject to Section III of this Agreement. <br />SECTION V. <br />All chemicals used by Contractor must be a chemical which has been previously approved by the <br />Environmental Protection Agency, the North Dakota State Department of Health and the Cass County Public <br />Health Department prior to application. Further, all chemicals must be applied according to the <br />manufacturers' label, terms and specifications. <br />SECTION VI. <br />Contractor shall comply with all applicable statutes, ordinances, rules, regulations, and orders of all <br />public agencies and authorities relating to the aerial application of pesticides over residential areas, <br />SECTION VII. <br />No waiver or modification of this Agreement or of any covenant, condition or limitation herein <br />contained shall be valid unless in writing and duly executed by the party to be charged therewith and no <br />evidence of any proceeding, arbitration, or litigation between the parties hereto arising out of or affecting this <br />Agreement, or the rights or obligations of the parties hereunder, unless such waiver or modification is in <br />writing, duly executed as aforesaid and the parties further agree that the provisions of this section may not <br />be waived as herein set forth. <br /> <br />SECTION VIII. <br />Contractor will immediately secure public liability insurance in the minimum amounts as follows: <br />. Non-Chemical: <br />$1,000,000 Public Liability (bodily injury and property damage) combined single limit. <br />Page 3 <br />
