<br />38. WASTE TRANSPORTATION <br /> <br />A. Contractor agrees to' provide Department with the name, address, EPA <br />identification number and a brief description of each Waste transporter used <br />during contract performance. This includes Contractor's subsidiaries, or any <br />proposed subcontractors, agents, or other persons transporting Waste <br />collected under the contract even if no privity of contract exists between <br />Contractor and such person. Contractor will provide Department with the <br />transportation permit numbers for each transporter for each of the states, in <br />addition to the State of North Dakota, in which the transporter will operate. <br /> <br />Contractor agrees that no transporter other than those listed will be used <br />without obtaining the prior written approval of Department <br /> <br />B. Placarding of each transportation vehicle will be in compliance with NDAC. <br />ch 33-24-03 and by 40 CFR. S 262. In the event of a discharge of the <br />Waste during transportation, Contractor will take immediate action to protect <br />public health and the environment as required by NDAC. section 33-24-04- <br />07 and by 40 C.F.R S 263. <br /> <br />39. ADDITIONAL DOCUMENTATION <br /> <br />All reports required under this section must be thoroughly and accurately completed <br />to the satisfaction of Department Contractor will promptly complete the following <br />reports: <br /> <br />A Written notice of any deviation of more than 10 days from the project <br />schedule provided in the contract and the cause for such deviation; <br /> <br />B. Any land ban exemption notifications provided to EPA; <br /> <br />C. Written notice of any EPA or North Dakota pre-treatment requirements; <br /> <br />D. A Final Contract Report specifically describing all activities that occurred <br />during the project period must be submitted within 180 days after the <br />completion of the last collection event A final Waste tracking report, which <br />will fully account for all Waste from collection sites to treatment or disposal <br />facilities, must be submitted with the Final Contract Report; <br /> <br />E. Documentation verifying that scales were certified for use for the collection <br />events prior to final payment <br /> <br />40. FINAL TREATMENT OR DISPOSAL <br /> <br />A Unless otherwise agreed in writing, all Waste must have undergone final <br />treatment or disposal by December 31,2005. <br /> <br />18 <br />
