<br />(2) Amount spilled and whether it is EPA or state reportable and, if so, <br />whether it was reported; <br /> <br />(3) Exact time, date and location of spill, including a description of the <br />area involved <br /> <br />(4) Containment procedures initiated; <br /> <br />(5) The direction and estimated speed of the wind and estimated <br />temperature at the time of the spill; <br /> <br />(6) Summary of any communications Contractor has had with press or <br />other government officials; <br /> <br />(7) Description of clean-up procedures employed or to be employed at <br />the site, including disposal location of spill residue; <br /> <br />(8) Any witnesses involved and names of all individuals involved in <br />preparing any reports required by this part; <br /> <br />(9) The date and time of the original telephonic report and the name of <br />the person it was reported to; and <br /> <br />(10) A spill incident report for each spill or discharge occurring at a <br />collection site or during Waste transportation, regardless of size or <br />amount, containing the information required under N.D.A.C. 33-24- <br />04-07 and 40 C.F.R. S 263. <br /> <br />29. SAFETY <br /> <br />Contractor shall have and maintain an adequate health and safety program to <br />safeguard people and property from injury or damage. Contractor shall perform all <br />operations in a prudent, conscientious, safe and professional manner. At a <br />minimum, Contractor personnel and equipment will comply with applicable federal <br />and state laws, safety regulations and procedures, and will ensure that its agents, <br />employees, and subcontractors perform in a safe manner. Contractor will ensure <br />that all personnel involved in handling and packaging the Waste are trained for the <br />level of expertise required for the proper performance of the task and, in particular, <br />in the areas of chemical incompatibility, general first aid procedures and spills. <br />Personal protective equipment must be provided by Contractor and must be <br />appropriate to ensure safe handling of the Waste. Contractor agrees that its <br />personnel and equipment are subject to safety inspections by State. <br /> <br />Contractor will provide Department with safety and emergency plans for each <br />collection event before the collection events. Contractor will conduct safety <br />meetings at each collection site to ensure Contractor and Department personnel <br /> <br />13 <br />
