<br />agencies, officers, or employees assumes no liability for any damage to <br />Contractor's property, to the property of any person, or public property or for <br />personal injuries, illness, disabilities or death to Contractor, Contractor's <br />employees, and any other person subject to Contractor's control or any other <br />person including members of the general public, caused, in whole or in part, <br />by (a) Contractor's breach of any contract term or provision; or, (b) any <br />negligent or willful act or omission by Contractor, its employees or <br />subcontractors in the performance of this contract <br /> <br />C. The foregoing indemnification provided to State by Contractor is intended to <br />protect fully the State for liability under any federal and state environmental <br />laws, including: <br /> <br />(1) North Dakota Hazardous Waste Management Act (N.D.C.C. ch. 23- <br />20.3) and North Dakota Hazardous Waste Rules (NDAC. Art. 33- <br />24); <br /> <br />(2) Federal Resource Conservation and Recovery Act of 1976 (RCRA); <br /> <br />(3) Federal Comprehensive Environmental Response, Compensation, <br />and Liability Act of 1980 (CERCLA); <br /> <br />(4) Federal Hazardous Material Transportation Regulations (49 C.FR <br />SS 171, 172, 173, and 177 for hazardous materials transportation <br />regulations ); <br /> <br />(5) Control, Prevention and Abatement of Pollution of Surface Waters <br />(ND.C.C. ch. 61-28); <br /> <br />(6) Solid Waste Management and Land Protection Act and Solid Waste <br />Management and Land Protection Rules (ND.C.C. ch. 23-29 and <br />NDAC. Art. 33-20); and <br /> <br />(7) Federal Occupational Safety and Health Act of 1970 (OSHA). <br /> <br />11. PERSONAL LIABILITY <br /> <br />No State officer or employee will be personally liable or responsible for any <br />covenant or agreement herein contained whether expressed or implied, or for any <br />statement or representation made herein or in any connection with this contract <br /> <br />12. SUPERVISION AND COORDINATION <br /> <br />Contractor will: <br /> <br />A. Competently and efficiently supervise and direct the implementation and <br />completion of all contract requirements. <br /> <br />5 <br />
