'.' C. Contractor will be paid 60% of the Waste handling costs as Department receives proper certificates of treatment or disposal for the Waste. D. Contractor will be paid the final 20% of the Waste handling costs after Department receives and accepts the "Final Contract Report" as described in paragraph 39, and after final treatment or disposal of all Waste received during collection events, as verified by certificates documenting the final Waste treatment or disposal. E. Payments to Contractor fully compensate Contractor for all risk, loss, damages or expense of any nature and acceptance of payment constitutes a waiver of all claims Contractor may have. This will be the sole and complete compensation for services rendered by Contractor. 4. CONTRACTOR'S REPRESENTATIVE A. Responsibility. Contractor's representative will function as the primary point of contact, will ensure supervision and coordination, and will take corrective action as necessary to meet contractual requirements. B. Availability. Contractor's representative, or designee, will be available at all times throughout the collection phase of the contract term and will make his or her location known to Department. 5. CONFLICT AND SEVERABILITY A In the event of conflict between the contract and applicable laws, codes, ordinances, regulations, or orders or in the event of any conflict between such applicable laws, ordinances, regulations, or orders, the most stringent or legally binding requirement governs and is considered a part of this contract to afford Department the maximum benefits thereof. B. Any contract provision found to be prohibited by law is ineffective only to the extent of such prohibition without invalidating the remainder of the contract. 6. NONDISCRIMINATION AND AFFIRMATIVE ACTION Contractor will abide by the terms and conditions of Section 601, Title VI, Civil Rights Act of 1964, as may be amended, in that: No person in the United States shall, on the grounds of race, color, national origin, sex or age, be excluded from participation in, be denied the benefits of, or be subject to discrimination under any program or activity receiving Federal financial assistance. In addition, no otherwise qualified handicapped individual in the United States shall, solely by reason of his handicap, be excluded from the participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving Federal financial assistance. 3
