<br />'.' <br /> <br />C. Contractor will be paid 60% of the Waste handling costs as Department <br />receives proper certificates of treatment or disposal for the Waste. <br /> <br />D. Contractor will be paid the final 20% of the Waste handling costs after <br />Department receives and accepts the "Final Contract Report" as described in <br />paragraph 39, and after final treatment or disposal of all Waste received during <br />collection events, as verified by certificates documenting the final Waste <br />treatment or disposal. <br /> <br />E. Payments to Contractor fully compensate Contractor for all risk, loss, damages <br />or expense of any nature and acceptance of payment constitutes a waiver of all <br />claims Contractor may have. This will be the sole and complete compensation <br />for services rendered by Contractor. <br /> <br />4. CONTRACTOR'S REPRESENTATIVE <br /> <br />A. Responsibility. Contractor's representative will function as the primary point <br />of contact, will ensure supervision and coordination, and will take corrective <br />action as necessary to meet contractual requirements. <br /> <br />B. Availability. Contractor's representative, or designee, will be available at all <br />times throughout the collection phase of the contract term and will make his <br />or her location known to Department. <br /> <br />5. CONFLICT AND SEVERABILITY <br /> <br />A In the event of conflict between the contract and applicable laws, codes, <br />ordinances, regulations, or orders or in the event of any conflict between <br />such applicable laws, ordinances, regulations, or orders, the most stringent <br />or legally binding requirement governs and is considered a part of this <br />contract to afford Department the maximum benefits thereof. <br /> <br />B. Any contract provision found to be prohibited by law is ineffective only to the <br />extent of such prohibition without invalidating the remainder of the contract. <br /> <br />6. NONDISCRIMINATION AND AFFIRMATIVE ACTION <br /> <br />Contractor will abide by the terms and conditions of Section 601, Title VI, Civil <br />Rights Act of 1964, as may be amended, in that: <br /> <br />No person in the United States shall, on the grounds of race, color, national <br />origin, sex or age, be excluded from participation in, be denied the benefits <br />of, or be subject to discrimination under any program or activity receiving <br />Federal financial assistance. In addition, no otherwise qualified <br />handicapped individual in the United States shall, solely by reason of his <br />handicap, be excluded from the participation in, be denied the benefits of, or <br />be subjected to discrimination under any program or activity receiving <br />Federal financial assistance. <br /> <br />3 <br />
