<br />.' <br /> <br />.' <br /> <br />The 2005 Request for Pr6p6sai {"RFP") Number 602-05-001, is hereby <br />incorporated by reference and made a part of this contract In case of a conflict <br />between the RFP and this contract, this contract will govem in all cases. <br /> <br />Contractor agrees that it is the generator for all Waste. The parties agree that <br />Contractor is, and assumes the responsibilities of, the generator of the Waste <br />collected under this contract, based on the following: <br /> <br />A. Contractor is engaged in the business of collection, transportation, storage, <br />treatment, and disposal of hazardous waste; and Contractor has technical <br />expertise in that business and all licenses required to perform that business. <br /> <br />B. Contractor's technical expertise was critical to the North Dakota Department <br />of Agriculture's {"Department") determination to enter into this contract with <br />Contractor. <br /> <br />C. Contractor is responsible for the characterization, packaging, storage, <br />transportation, treatment, and final disposal of all Waste collected under this <br />contract. <br /> <br />D. Contractor makes all necessary decisions and determinations regarding the <br />arrangements for collection, transportation, storage, treatment, and disposal <br />of Waste, except as specifically stated herein. <br /> <br />3. COMPENSATION <br /> <br />Department agrees to pay Contractor $49,800 for sixteen sites for "Mobilization <br />Costs" and $.85 lb. for Waste. Department will pay based upon actual services <br />completed according to the following schedule and upon receipt of invoice: <br /> <br />A. Contractor will first receive compensation for Mobilization Costs, which will be <br />paid upon: <br /> <br />(1) Completion of all collection events and submission of the required <br />documents pursuant to paragraph 36 entitled "Waste Records, <br />Packaging and Storage"; <br /> <br />(2) Submission of copies of all signed manifests pursuant to paragraph 37 <br />(C)(1); and <br /> <br />(3) Completion of the laboratory characterization of unknown Waste and <br />submission of required documents pursuant to paragraph 35. <br /> <br />B. Contractor will be paid 20% of the Waste handling costs when Department <br />receives all signed manifests verifying receipt of all Waste by an approved final <br />treatment or disposal facility. <br /> <br />2 <br />
