Proposals

Requests for
Bids or
Proposals

Architect,
Engineer, and
Land Surveying
Services

An agency subject to bidding requirements should be very careful
to review and follow all requirements set out in law and
administrative rule.

A request for proposals, often referred to as an "RFP," is similar to
the bid process but gives the agency additional fiexibility after
receiving proposals from potential contractors. Frequently, the
process includes competitive negotiation with the bidders based
on a comparison of the proposals received by the agency.

When preparing a request for bids or proposals, the agency
should specify the terms and conditions it will require in the
contract and those that are unacceptable. This gives potential
contractors notice of the state's contracting requirements.
Solicitation templates are available at OMS's Procurement Office
web site at:

http://www.state.nd.us/csd/spo/solicitation-templates.html

The procurement of architect, engineer, and land surveying
services is governed by ND.C.C. ch. 54-44.7.

6
